RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ACCEPTING THE ELECTION OFFICIAL'S CERTIFICATION OF SUFFICIENCY OF THE
REFERENDUM PETITION FOR RESOLUTION 2022-046
WHEREAS, on June 30, 2022, the Town Council adopted Resolution 2022-046, adopting
the 2024 General Plan to update the 2020 General Plan, along with the Final Environmental
Impact Report (EIR); and
WHEREAS, on August 15, 2022, the proponents of the referendum to repeal the Land
Use and Community Design Elements of the adopted 2024 General Plan filed with the Elections
Official petitions containing 3,417 unverified signatures; and
WHEREAS, to qualify, the proponents were required to obtain signatures of ten percent
(10%) of the of the 21,978 registered voters of the Town for a total of 2,198; and
WHEREAS, the Town Clerk and Town Attorney found that the petition's form complies
with the Elections Code; and
WHEREAS, on August 17, 2022, the petition was delivered to the Santa Clara County
Registrar of Voters Office (ROV) for signature verification; and
WHEREAS, in accordance with Election Code Section 9115, the ROV examined 500
random signatures and notified the Town Elections Official Elections of the results;
WHEREAS, on September 27, 2022, the ROV certified that the Petition has a projected
number of 2,961 (134.7%) estimated valid signatures and the statistical sampling is over 110
percent.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Los Gatos
does declare and determine, that pursuant to Election Code Section 9115 subsection (f), the
Town Elections Official has submitted the certified results of the random sample signature
examination of the referendum petition for Resolution 2022-046 as verified by the Santa Clara
County Registrar of Voters Office (Exhibit A).

Dear City Clerk Wood:
The petition named above was submitted to our office on August 17, 2022 and contained a raw count of 3,417 signatures.
Pursuant to your request, 10% of the number of registered voters for the Town of Los Gatos, per the April 13, 2022 Report
of Registration would equal 2,198 valid signatures to pass.
Your jurisdiction requested that the Registrar of Voters' Office conduct signature verification on the petition. The Registrar
of Voters' Office verified the necessary number of signatures filed in accordance with Elections Code Section 9115.
The signature verification process resulted in the verification of 500 signatures of which 445 signatures were found valid.
In accordance with California Administrative Code 20530, the petition has a projected number of 2,961 estimated valid
sig natures.

I, SHANNON BUSHEY, Registrar of Voters of the County of Santa Clara, State of California,
hereby certify:
That the "Referendum Against a Resolution Passed by the Town Council" was submitted
for signature verification on August 17, 2022.
That said petition consists of 159 sections;
That attached to this petition at the time it was filed was an affidavit purporting to be the affidavit
of the person who solicited the signatures, and containing the dates between which the
purported qualified electors signed this petition;
That the affiant stated his or her own qualification, that he or she had solicited the signatures
upon that section, that all of the signatures were made in his or her presence, and that to the
best of his or her knowledge and belief each signature to that section was the genuine signature
of the person whose name it purports to be;
That after the proponent filed this petition, I verified the required number of signatures by
examining the records of registration in this county, current and in effect at the respective
purported dates of such signing, to determine what number of qualified electors signed the
