RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
REMANDING A REQUEST FOR APPROVAL OF A PLANNED DEVELOPMENT
FOR CONSTRUCTION OF A SENIOR LIVING COMMUNITY, REMOVAL OF
LARGE PROTECTED TREES, AND SITE IMPROVEMENTS REQUIRING A
GRADING PERMIT ON PROPERTY ZONED R:PD
BACK TO THE PLANNING COMMISSION FOR FURTHER DISCUSSION
WITH CONSIDERATION OF COMMENTS
PROVIDED BY THE TOWN COUNCIL.

WHEREAS, on January 12, 2022, the Planning Commission held a duly noticed public
hearing and considered the public testimony, the staff report prepared for that meeting (Staff
Report), and all other documentation related to the Planned Development and Final EIR, and
forwarded a recommendation that the Town Council not certify the Final EIR (EIR-21-002) and
deny the Planned Development (PD-20-001).
WHEREAS, this matter came before the Town Council for public hearing on April 5, 2022,
and was regularly noticed in conformance with State and Town law.
WHEREAS, the Town Council received testimony and documentary evidence from the
applicant and all interested persons who wished to testify or submit documents. The Town
Council considered all testimony and materials submitted, including the record of the Planning
Commission proceedings and the packet of material contained in the Council Agenda Report for
their meeting on April 5, 2022, along with any and all subsequent reports and materials
prepared concerning this application.
NOW, THEREFORE, BE IT RESOLVED:
1. The request for approval of a Planned Development for construction of a senior living
community, removal of large protected trees, and site improvements requiring a grading permit
on property zoned R:PD is remanded back to the Planning Commission for further discussion with
consideration of comments provided by the Town Council.

2. The decision does not constitute a final administrative decision and the applications
will be returned to Planning Commission for further consideration.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 5th day of April, 2022, by the following vote:
