SUBJECT: PROPOSED VACATION OF A PORTION OF LAUREL AVENUE
(FARWELL AND ALLEN)
DATE: SEPTEMBER 30, 1980
At their meeting of September 15, 1980, the Town Council adopted a
Resolution of Intention to vacate a portion of Laurel Avenue.
The portion of the street area proposed to be vacated is 20 feet wide
(leaving 40 feet of right-of-way), and slopes steeply up from the road,
rendering it useless for street purposes. Vacation of the 20-foot strip
is proposed as a solution to lot width deficiencies in a proposed
two -lot subdivision of the property. We have found that it is not
necessary to retain any easements on the portion of Laurel to be vacated.
Mr. Farwell and Mr. Allen have paid a $100.00 fee to cover the cost
of the proceedings.
The Notice of the Resolution of Intention to Vacate has been advertised
and posted, as required by law. We are not aware of any objections to
the proposed vacation.
We therefore recommend that the Council hold a public hearing on this
matter, and if, after hearing, they desire to proceed with the vacation,
take the following action:
1. Find that the portion of Laurel Avenue proposed to be vacated
is unnecessary for present or prospective public street purposes.
2. Adopt the Order of Vacation, authorize the Mayor and Clerk to
sign, and direct the Clerk to record the Order.
