The applicant is requesting approval of a variance to construct a 576 square foot detached garage within the required front
setback on a one acre parcel prezoned HR-2''A. The proposed structure meets the Town's height requirements. The plans
do not indicate whether the existing house contains a garage. If the house currently contains a garage, a recommendation
for denial of the variance should be forwarded to the County. If a garage does not exist then the recommendation is as
follows. The proposed front setback is 11 feet. The Town permits the front setback for sloping lots to be reduced up to
50%. Therefore the required front setback for this property, if located within Town limits would be 15 feet. Due to the
shape and topography of the lot and the existing tree locations, the required fmdings can be made to grant a variance. The
minimum back up distance required by the Town is met since the garage opening is located on the side of the building.
Therefore, a recommendation for approval should be forwarded to the County, subject to the condition that the size of the
garage be reduced so that it has an interior clear dimension of 20 feet by 20 feet. The reduction in size meets the minimum
Town requirements for a two car garage and will increase the front setback to approximately 14 feet and the side setback
to approximately 11 feet which is more conforming.

Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council accept the report concerning
County Referrals:

PLANNING COMMISSION & DEPARTMENT MONTHLY STATUS REPORT (03.47)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council accept and file informational
monthly status report regarding Planning Department. Carried unanimously.
RATIFICATION OF PAYROLL/APRIL 2000 (04.V)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council ratify the check registers for the
payrolls of April 16, 2000 through April 29, 2000, paid on May 5, 2000, in the amount of $400,010.59.
Carried unanimously.
ACCOUNTS PAYABLE/RATIFICATION/APRIL 2000 (05.V)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council ratify the accompanying check
registers for accounts payable invoices paid on April 28, 2000, and May 5, 2000 in the amount of
$649,634.73. Carried unanimously.
AMICUS BRIEF/HOME BUILDERS NORTHERN CALIF/VS/CITY OF NAPA (06.01)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council authorize the Town Attorney to join
the Town Attorney to join the Town of Los Gatos in the amicus curiae brief in the case of Associated
Home Builders of Northern Californiz vs. City of Napa, California Court of appeal Case #A090437,
at no cost to Town. Carried unanimously.
PLANNING COMMISSION/COMMENDATION/SANDY DECKER/RESOLUTION 2000-47 (07.20)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council adopt Resolution 2000-47 entitled,
RESOLUTION OF THE TOWN OF LOS GATOS COMMENDING SANDY DECKER FOR
HER SERVICE TO THE TOWN AS A MEMBER ON THE PLANNING COMMISSION.

BRIDGE STRUCTURES/PROJECT 9935/SEISMIC RETROFIT/RESOLUTION 2000-48 (08.35)
Motion by Mr. Hutchins, seconded by Mr. Pirzynski, that Council adopt Resolution 2000-48 entitled,
RESOLUTION OF THE TOWN OF LOS GATOS APPROVING PLANS AND
SPECIFICATIONS FOR PROJECT 9935 - SEISMIC RETROFIT - TWO BRIDGE
STRUCTURES AND AUTHORIZE THE CLERK TO ADVERTISE FOR BIDS. This motion
includes the information received in this evening's desk item. Carried unanimously.
