ACCEPT STAFF RECOMMENDATIONS ON COUNTY REFERRALS REFERRAL NUMBER LOCATION APPLICANT REQUEST RECOMMENDATION A. Projects Outside Urban Service Area: None B. Projects Inside Urban Service Area: 8014 Wagner Road Barth Design Review Approval/two conditions The applicant is requesting approval to construct two storage barns on 16.17 acres prezoned HR-20 (see map attached). The barns will contain 1,690 square feet and 3,240 square feet. The structures meet Town setback requirements. The maximum height of each structure will be 22 feet. The request did not define whether or not the barns will be used for horses. Therefore, Council should direct staff to forward a recommendation for approval to the County subject to the following recommended conditions: 1. If the storage barns are used for horse barns or horse shelters, the maximum height shall not exceed 22 feet above existing or finished grade, whichever has the lower profile. If the buildings are not used for horse barns or shelters, the maximum height shall not exceed 15 feet. 2. The exterior color of the buildings shall have a light reflectivity value of 30 or less and shall blend with the natural color of vegetation that surrounds the site. REF.wpd 0 Town Council Minutes June 4, 2001 Redevelopment Agency Los Gatos, California COMMUNITY HOUSING DEVELOPERS/LOCAL DEVELOPMENT CORPORATION LOS GATOS CREEK VILLAGE/MILES AVENUE 31 CONT. Fr. Bill Leininger, 121 Verde Court, representing the Housing Committee for the Interfaith Council for Race, Religion and Housing for Santa Clara Valley, asked that Council waive the street fees and help this project get people into homes. He mentioned the 38,000 homeless in Santa Clara County and the need for government assistance in meeting this problem. Forrest Crumpley, 16464 Shady View Lane, speaking for Economy and Social Justice and the Affordable Housing Network, asked that Council approve these adjustments and help applicants move into their homes. Nancy Burbank, 108 Belcrest Drive, representing the League of Women Voters, asked for Council's support for affordable housing, and spoke of the need to offer housing options for employees of our Town. Wiggsy Sivertsen, 255 Jones Road, spoke of community and people caring about their neighbors and asked that Council move quickly to approve this proposal and allow people to move into their homes. Betty Feldheym, 20184 Franklin Avenue, Saratoga, she praised Los Gatos for having supplied affordable housing but asked if Council would move forward quickly on this project. She spoke of representing the Housing Committee of the Los Gatos Uniterian Fellowship; and the Housing Committee of the Interfaith Council on Religion, Race, Economic and Social Justice. Mary Lyle Remple, representing West Valley Open Doors a non profit charitable housing development corporations, co-sponsors of Open Doors Apartments on West Parr Avenue urged Council to waive the Town's traffic impact fees. Bonnie Bamburg, 255 N. Market Street, #290, Development Director ofNew Housing Development for Community Developers Local Development Corporation spoke of a submitted letter and clarified the connection with Community Housing Developers. Motion by Mr. Attaway, seconded by Mrs. Decker, to close the public discussion. Carried unanimously. Motion by Mr. Blanton, seconded by Mr. Attaway, to direct staffto proceed with loan documents and related security measures as follows: A). Loan of $233,800 to Community Developers -Local Development Corporation from Redevelopment Agency Housing Set -Aside funds, at 3% annual simple interest, principal and interest payable from one-half of net cash flow after debt service, with a term of 50 years. Loan due and payable upon sale of property. B). Document to require loan is also due and payable with net income exceeding $100,000 from sale of 221 Los Gatos Boulevard (Hartin House.) C). Lien that Community Housing Developers would record to secure loan with both 31 Miles Avenue (Los Gatos Creek Village) and 95 Fairview Plaza. D). Affordability restriction that Community Housing Developers would record on 95 Fairview Plaza, which restricts its use to affordable housing only, for the period from May 28, 1986 to May 28, 2036. E). Waiver of the Traffic Impact Mitigation Fee, including a finding that Los Gatos Creek Village provides a significant community benefit by meeting current needs for affordable housing. Carried unanimously. COUNTY REFERRALS (02.38) Ray Davis, resident, asked that Town insist that County use Town's rules in our sphere of influence. Mrs Decker asked that staff spend time with County in dialog and request that County err on restrictive rather than lenient interpretations. Increased communications addressing our concerns is needed. Motion by Mr. Pirzynski, seconded by Mr. Attaway, that Council accept the report concerning County Referrals: NUMBER LOCATION APPLICATION REQUEST RECOMMENDATION 8014 Wagner Road Hibberd Building Site Approval/No Conditions Carried unanimously.
