Status of Previous Applications: 7843 & Frontage Rd -Hwy 17 Lexington Builders Inc Building Site 7844 Grading The County of Santa Clara has prepared draft conditions of approval for the above referenced applications and final action is scheduled to be taken on January 22, 2002 (Attachment 1). Town Staff has requested that the County postpone final action until January 23, 2002 in the event Council recommends further changes to the preliminary conditions of approval. The County has been working with the California Division of Forestry and Fire Protection (CDF) in developing the conditions of approval to preserve the helipad. Only one condition has been included for each project relating to the helipad, which requires the property owner to record with the County Recorder, an acknowledgment that they have full knowledge of the existing helicopter operations by CDF on the adjacent parcel. A condition concerning a navigation easement was not included since the legal counsel of CDF determined that this condition should not be pursued. Although it is not required, CDF is working with Caltrans to relocate the helipad on site so that the flight path would not cross the subject parcels. CDF agreed to inform the Town in writing of the outcome of the meeting with Caltrans and that they are satisfied with the conditions of approval for the subject applications. This letter will be forwarded to Council when received. In addition, the County's final action on these applications will also be forwarded to Council. Attachments: 1. A tree removal permit will be required to remove any tree with the main trunk or stem measuring 37.7 inches or greater in circumference (12 inches or more in diameter) at a height of four and one-half feet above ground level. In the case of multi -trunk trees, a total of 75.4 inches in circumference (24 inches in diameter) will require a tree removal permit per Sec. C16 County Ordnance Code. Grading: 7.*** This project qualifies as a categorical exemption from the California Environmental Quality Act (CEQA) because the volume of grading be less than 500 cubic yards. If the project exceeds 500 cubic yards, a reevaluation of the exemption will be required. 8. * * * Prior to obtaining a grading permit, submit a tree protection plan or include the plan on the final grading plans, for Planning Office review and approval. The plan shall indicate protective fencing around existing trees to prevent construction equipment from encroaching upon the root zones of the trees. Standard dust control measures must be employed to ensure that any air quality impacts remain insignificant. The landscaping shall includes a mixture of native trees, shrubs, and ground cover of varying species. Developer must provide County with Certificate of Worker's Compensation Insurance. Utilities: 21.** All new on -site utilities, mains and services are to be placed underground and extended to serve the proposed residence. Off -site work should be coordinated with any undergrounding to serve other properties in the immediate area. 22.* If developer proposes to install a water system that is not an existing public domestic water system operating under a valid permit, then he shall submit an engineered water system report and water system improvement plans prepared by a registered civil engineer as provided in Section C12-198 of County Ordinance Code. Said report and plans to be submitted for review and approval to the Health Department, Fire Marshal, Land Development Engineering and Building Inspection. Soils: 23.*& Submit soils report by a registered civil engineer. *** Grading: 24.*** Preliminary grading plans done by Mason-Sulic have been reviewed. Final grading plans are to be prepared by a registered civil engineer and submitted as set forth in the Grading Ordinance Section C12-412. NOTE: All materials exported from the site must be located at an approved disposal site. 25.*** Indicate on final plan how graded area is to be properly drained in accordance with criteria as designated in the County Drainage Manual. Submit necessary hydraulic calculations. 26.*** Comply with setback requirements from property line for cuts and fills per Section C12-505. 27.*** Expose corner stakes along property lines near proposed grading. Show on final grading plans. 28.*** Post bonds, sign grading agreement and pay necessary inspection and plan check fees. 29.*** Final grading plans shall be prepared and submitted on "Standard Improvement Plan Mylar" as approved by the County Surveyor. Sewage disposal conditions have been determined and 400 plus 400 lineal feet of subsurface drainline will be required. The two drainline systems must be connected through a positive diversion valve. A 2000 gallon septic tank will be required. This system is adequate to serve a four bedroom home with no more than 4,500 square feet of living area. This system will include a 1500 gallon pump tank. 32.* At the time of application for a building permit, submit five (5) revised plot plans to scale (1" = 20') showing house, driveway, accessory structures, septic tank and required drainlines to contour. in order to obtain a septic system permit. Plans must clearly show the actual lines to he installed in relation to the high water mark (657' elevation) of the reservoir. Maintain all setbacks as -outlined in yBulletin A. The plans must be submitted to the field office for sign -off prior to the issuance of the septic system permit. Grades 15% or greater require engineered plans, hard surface paving, and shall not exceed 300 ft. in length. b) All road surfaces must sustain 40,000 pounds loading and shall have an all weather surface. Work to be completed prior to combustible material brought on site. 42. * Driveway (road that serves only one lot) shall have a clear width of 12ft. with one 3 ft. shoulder. a) All road surfaces must sustain 40,000 pounds loading and shall have an all weather surface. Inside turn radius should be a minimum of 42-ft. Maximum grade shall not exceed 20%. Grades 15% or greater require engineered plans, hard surface paving, and shall not exceed 300 ft. in length. NOTE: The following requirements shall apply if the distance (as measured along path of travel) from the access road to the farthest point of the house is more than 150 ft. b) Passing turnouts (8ft by 40-ft) shall be provided at every 500 ft. c) Provide adequate parking and turnaround detail for 4 emergency vehicles at the site when the farthest point of the house is more than 150 ft. from the road (measured along the path of travel). Acceptable turnaround shall be 40 ft. by 48-ft. pad, hammerheads, or bulb of 32-ft radius. All turnarounds shall have a slope of less than 5%. d) Work to be completed prior to combustible material brought on site. Miscellaneous: 43. Property is located in the Santa Clara County Fire Department Fire Response Area. 44. This property is located in a Hazardous Fire Area. All of the following conditions shall apply: a) Remove combustible vegetation within 30 to 100 ft. of the structure. b) A class "A" roof is required. Show in detail on the building plans. c) Provide a 1/2 in. spark arrester for the chimney. Remove vegetation within 10 ft. on each side of the roof.
