RECOMMENDATION:
Forward a recommendation of approval subject to three conditions.
REMARKS
The applicant is requesting approval of plans to convert an existing single family residence to storage and to construct a new
two story single family residence on a 16 acre parcel prezoned HR-20. The residence meets all setback requirements. A
recommendation for approval should be forwarded to the County with the following recommended conditions of approval:

The existing house which is proposed to be converted to a storage building shall be one story, with a maximum
height of 15 feet above existing grade. The kitchen shall be removed from the structure prior to final occupancy
of the new residence.
The maximum height of the proposed residence shall not exceed 30 feet above existing grade.
The exterior colors shall not exceed a light reflectivity value of 30.

Forward a recommendation of approval subject to no conditions.
REMARKS
The applicant is requesting approval of plans to demolish a single family residence and to construct a new residence on a 22,544
square foot nonconforming lot prezoned HR-20. The lot is nonconforming since it does not meet the minimum lot frontage of
100 feet (the lot only has 75 feet). Since the lot is nonconforming, the 15 foot side yard setback has been reduced to 8 feet. No
building plans have been submitted at this time.
A recommendation for the building site approval should be forwarded to the County subject to no conditions.

Notice of Preparation of a Draft Environmental Impact Report
RECOMMENDATION:
None at this time.
REMARKS:
The Town has received a Notice of Preparation of a Draft Environmental Impact Report for a use permit for an 18 hole semi-
public golf course with a 5 acre driving range with 25 turf tee boxes; a 6,500 square foot clubhouse, two maintenance buildings
totalling 10,000 square feet, and employee housing (four single family residences, one duplex and one triplex) on 210 acres
located outside of the Town's Urban Service Area Boundary. The Use Permit proposal also includes an 18,000 square foot
athletic club (fitness center and spa, locker room, restaurants, banquet/meeting rooms) along with two swimming pools and ten
tennis courts. The athletic club would occupy the former Alma College facilities and is intended for use by club members only.
The restaurant proposed at the athletic club is intended for use by club members and the general public. The golf course is
intended for the use of the country club members, with the exception of one day a week when it would be open to the public.
The driving range would be open for use by the general public.
The proposed project is essentially the same in character as the project analyzed in the previous Los Gatos Country Club EIR
prepared in 1995, although a number of changes have been made to the details of the project. The original use permit was
denied by the County Board of Supervisors on November 19, 1996. The main substantive change is that the project is no longer
proposed to be split into two phases. Thus, the project elements that were proposed to be built subsequently in a second phase,
namely the athletic club, restaurant, duplex and triplex, are now to receive project -specific analysis in the EIR. Town Council
considered the matter on November 6, 1995 and forwarded a neutral recommendation to the County, provided that the County
enforced the mitigation measures as drafted in the EIR and two conditions dealing with requiring a water conservation program
and that no occupancies be granted until the Bear Creek Road interchange is completed and open.
Since the proposed athletic club and restaurant are to receive project -specific analysis in the new EIR, a detailed site plan,
geotechnical study, and wastewater system plan for these facilities will be prepared. In addition, a supplemental biological study
and an analysis of impacts on the historic resources of the former Alma College complex will be required. The traffic study will
also updated to reflect other changes to the project or changes to the external conditions that have occurred since the previous
EIR was completed.
The County has been informed to keep in continual contact with the Town on the status of this project. All information will be
forwarded to Council when available.

Mayor Benjamin announced that one application had been received from Ellen Graff for one
vacancy on the Redevelopment Advisory Committee. Voting was held and Ms Graff was
reappointed to term ending August 1, 2001.
RENT ADVISORY COMM/WILLIAM KRAUS/CLOVIS MIRASSOU/APPOINTMENTS (YY.20)
Mayor Benjamin announced that two applications had been received from William Kraus and
Clovis Mirassou for two vacancies on the Rent Advisory Committee. Voting was held and Mr.
Kraus and Mr. Mirassou were reappointed to terms ending March 1, 2000.

AMICUS BRIEF/LANDGATE V. CALIFORNIA COASTAL COMMISSION (08.01)
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council authorize the Town Attorney
to include the Town of Los Gatos as an amicus curiae in the case of Landgate v. California
Coastal commission, California Supreme Court action SO59847, at no cost to the Town.
