RECOMMENDATION:
Forward a recommendation of approval subject to one condition.
BACKGROUND
On August 2, 1996 Town Council recommended approval of a building site and design review for a single family residence
at this site. The Circulation Element of the Los Gatos Hillside Specific Plan indicates that future plans are to extend Diduca
Way through this subject property back to Shannon Road. The proposed location of the residence was determined to not
interfere with this future through road.
REMARKS
The applicant is now requesting approval of grading plans to accommodate the residence, driveway and accessory
structures on a 29 acre parcel prezoned RC. The proposed cut and fill do not balance, therefore a recommendation for
approval should be forwarded to the County, subject to the condition that any excess dirt material shall be hauled off the
site and not spread out on the subject property.

TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 110 East Main Street, at 7:37 p.m., Monday, August 18, 1997, in regular
session.
ROLL CALL

Randy Attaway, Steven Blanton, Jan Hutchins,
Linda Lubeck and Mayor Joanne Benjamin.
None.
PLEDGE OF ALLEGIANCE
Given by all in attendance.
CLOSED SESSION
Town Attorney, Orry Korb, announced that
Closed Session pursuant to Government Code
State of California, et al. v. Bank of America,
- Action 968-484. Council voted 4 to 0, with
decision, to intervene in this action.
.prior to this evening's meeting Council met in
Section 54956.9(a) (Pending Litigation) to discuss
NT & SA, San Francisco County Superior Court
the Mayor absent, to ratify the Town Attorney's
Pursuant to Government Code Section 54957 (Personnel), regarding the Evaluation of the
Town Manager. There is no report at this time.
MUSIC IN THE PLAZA SPONSORS/COMMENDATIONS (00.20)
Mayor Benjamin commended the following businesses for their generosity in supporting this
year's Music in the Plaza concert series. She noted that this event was coordinated jointly by
the Town, the Arts Commission and the Community Services Department. Many generous
individuals contributed to this success with financial support, time and talent. John Tice went
to the business community and secured donations for the performances. He was unable to
attend this evening but Kathleen Carmel accepted his commendation for him. The Rotary Club
of Los Gatos, Andale Taqueria, The Rose Collection, The Boulanger, San Jose Opera Guild,
Calvary Church, and McHugh Lincoln Mercury, were represented and received their
commendations. Domus and Willow Street Pizza were also recognized. Those present thanked
the Town for opportunity to contribute to this unique community activity.

Informational report regarding currently scheduled public hearings was received and filed.
COUNTY REFERRALS (02.47)
Motion by Mr. Blanton, seconded by Mr. Hutchins, that Council approve the recommended
action concerning County Referrals:
