Projects inside Urban Service Area: APPLICANT REOUEST RECOMMENDATION 6829 16490 Ferris Avenue Lukin Certificate of Compliance Denial The applicant is requesting approval of a certificate of compliance to legalize two parcels on property prezoned R-1:8. Section 66451.30 of the State Subdivision Map Act lists several criteria defining when a parcel is considered not merged. One of the criteria is that the parcel must comprise of at least 5,000 square feet in area. Both of the subject parcels are less than 5,000 square feet in area. Therefore, based on the requirements of the State Subdivision Map Act, the lot is considered to be merged. Therefore, the Town has no alternative but to forward a recommendation of denial to the County. C. ROLL CALL Present: Randy Attaway, Steven Blanton, Linda Lubeck, Joe Pirzynski, and Mayor/Chairman Jan Hutchins. Absent: None. PLEDGE OF ALLEGIANCE Given by all in attendance. CLOSED SESSION Town Attorney, Orry Korb, announced that Council had met in Closed Session this evening pursuant to Government Code Section 54956.9(a), to discuss Pending Litigation to which the Town is a party, regarding Donald Bell, et al. vs. Town of Los Gatos, Santa Clara County Superior Court, Action CV76-9272. There was no reportable action. SCHEDULE OF PUBLIC HEARINGS (01.01) Informational report regarding currently scheduled public hearings was received and filed. COUNTY REFERRALS (02.47) Motion by Mr. Blanton, seconded by Mr. Attaway, that Council accept the report concerning County Referrals: NUMBER LOCATION APPLICANT REQUEST RECOMMENDATION 6829 16490 Ferris Avenue Lukin Certificate of Compliance Denial Carried unanimously. RATIFICATION OF PAYROLL/DECEMBER 1998-JANUARY 1999 (03.V) Motion by Mr. Blanton, seconded by Mr. Attaway, that Council ratify the check registers for the payroll of December 26 through January 9, 1999 paid on January 15, 1999, in the amount of $370,031.25. Carried unanimously. ACCOUNTS PAYABLE/RATIFICATION/JANUARY 1999 (04.V) Motion by Mr. Blanton, seconded by Mr. Attaway, that Council ratify the accompanying check registers for accounts payable invoices paid on January 15, and January 22, 1999 in the amount of $704,649.92. Carried unanimously. MINUTES OF JANUARY 19, 1999 (05.V) Motion by Mr. Blanton, seconded by Mr. Attaway, that Council approve the Minutes of January 19, 1999 as submitted. Carried unanimously.
