10 Staff Report - Amendment to Section 4.2 PC Policies and ProceduresTOWN OF LOS GATOS COUNCIL AGENDA REPORT DATE: July 28, 1995 TO: MAYOR AND TOWN COUNCIL FROM: TOWN MANAGER SUBJECT: BACKGROUND: COUNCIL AG NDA DATE: g✓✓7 �� ITEM NO. l C) ACCEPT STAFF REPORT OF PLANNING COMMISSION AMENDMENT TO SECTION 4.2 OF THE PLANNING COMMISSION POLICIES AND PROCEDURES. At the study session on January 7, 1995, members of the Town Council discussed the Planning Commission's policy on meeting with applicants. The Council asked that Section 4.2 of the Commission's Policies and Procedures be amended to reflect the actual practice of the Commission and also be in compliance with the law. The Town Attorney and Planning Director recommended the Commission adopt the following changes to Section 4.2: Property visits by individual commissioners are strongly encouraged before the Commission meeting. , Commissioners should wee state at the public hearing observations they may have made at the property, including the nature of any discussion held with applicants, neighbors, or other interested parties. However, Commissioners are discouraged from talking about the application with the applicant, applicant's representative(s) or members of the public at the site or otherwise. If a Commissioner does discuss the matter with any of the above, the Commissioner should state during the discussion that all aspects of the discussion will be revealed to the other Commissioners at the public hearing and that the final decision will be made at the public hearing based on all testimony and evidence presented including the information gathered in the site visit. Negative Declaration Application ND-94-4 Requesting approval of a master plan for the future expansion of a church facility in the R- 1:8000 zone and R-1:8000 (Prezone). The master plan will include demolition of an existing education and a residential building, construction of a new education, ministry and multi- purpose/gymnasium building, remodeling of existing facilities, and expansion of the parking lot. PROPERTY OWNER: Calvary Baptist Church MOTION On motion by Comm. Abkin, seconded by Comm. Rudolph, Item 7 was continued to June 28, 1995 . Decker moves, seconded by Comm. Morgan, for approval of the proposed amendment to Section 4.2 of the Planning Commission Policies and Procedures which states Commissioners should visit project sites, Commissioners are discouraged from discussing the project with anyone but if discussion is held the content of that discussion should be disclosed to the Planning Commission. Motion passes unanimously, 6-0. AYES: Commissioners Decker, Jensen, Morgan, Nachison, Pacheco, and Rudolph NOES: None ABSTENTIONS: None ABSENT: Commissioner Abkin ITEM 9 Sub -Committee Reports No sub -committee reports were made. August 7, 1995 Los Gatos, California HOUSING ELEMENT EVALUATION (09.47) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council receive and file informational report regarding the Town's Housing Element. Carried unanimously. PLANNING COMMISSION POLICIES AND PROCEDURES REPORT (10.47) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council accept staff report of Planning Commission Amendment to Section 4.2 of the Planning Commission Policies and Procedures. Carried unanimously. ASSISTANT PLANNER/PLANNING DEPARTMENT/BUDGET INCREASE (11.06) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council authorize increase of Planning Department budget by $42,710.00 to hire an Assistant Planner. Carried unanimously. JUNIOR ENGINEER/STREET IMPROVEMENTS/FUNDING/RESOLUTION 1995-99 (12.06) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council adopt Resolution 1995-99 entitled, RESOLUTION OF THE TOWN OF LOS GATOS AMENDING THE 1995-00 CAPITAL IMPROVEMENT BUDGET AND THE 1995-96 OPERATING BUDGET AND AUTHORIZING FUNDING FOR STREET IMPROVEMENTS AND REINSTATING THE JUNIOR ENGINEER POSITION, including information as presented in this evening's desk item. Carried unanimously. TRANSIT ASSIST PROGRAM DISSOLUTION (14.19) This item was pulled from the agenda. CLAIM REJECTION/WILLIAM LANGER (15A.01) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council reject claim of William Langer, Jr. for alleged property damage occurring on June 22, 1995. Carried unanimously. CLAIM REJECTION/MICHAEL BARBIERI (15B.01) Motion by Mr. Blanton, seconded by Mrs. Benjamin, that Council reject claim of Michael Barbieri for alleged property damage occurring on June 22, 1995. Carried unanimously.
