Accept the following corrected paragraph for amending the meeting schedule to include the Joint Meeting/Workshop:
An Administrative Draft of the Specific Plan has been distributed to the General Plan Committee and is being reviewed
by staff. The Draft Specific Plan will be completed in early July. A Joint Workshop held on July 19 will allow the work
on the Plan to continue with public hearings and adoption anticipated in early Fall 1999.

TOWN COUNCIL
The Town Council/Parking Authority/Redevelopment Agency of the Town of Los Gatos met
in the Council Chambers of the Town Hall, 110 East Main Street, at 7:30 p.m., Tuesday, July
6, 1999, in joint regular session.
ROLL CALL
Present: Randy Attaway, Steven Blanton, Linda Lubeck, Joe Pirzynski,
and Mayor/Chairman Jan Hutchins.
Absent: None
PLEDGE OF ALLEGIANCE
Given by all in attendance.
CLOSED SESSION
Town Attorney, Orry Korb, announced that Council had met in Closed Session prior to this
evening's meeting pursuant to Government Code Section 54956.9(b), Anticipated Litigation,
Claim of Julie Patricia Dunn. Council denied the claim.
Pursuant to Government Code Section 54957.6, Council met to discuss Labor Relations. Town
Negotiator (Lead): Gary Rogers, Personnel Manager and Association/Employees: Town
Manager, Town Attorney. There was no action taken at this time.
PRESENTATION/ARTS COMMISSIONER/LYNN KENNEDY (XXY.20)
Mayor Hutchins thanked Ms. Kennedy for her volunteer time on the Arts Commission and
presented her Commendation.
SCHEDULE OF PUBLIC HEARINGS (01.01)
Informational report regarding currently scheduled public hearings was received and filed.
PLANNING COMMISSION/TOWN COUNCIL JOINT SESSION (03.47)
Informational report regarding the Planning Commission and Town Council joint session
scheduled for July 19, 1999 regarding the North Forty Specific Plan was received and filed..
RATIFICATION OF PAYROLL/MAY-JUNE 1999 (04.V)
Motion by Mr. Blanton, seconded by Mayor Hutchins , that Council ratify the check registers
for the, payroll of May 30 through June 12, 1999 paid on June 18, 1999, in the amount of
$403,248.13. Carried unanimously.
ACCOUNTS PAYABLE/RATIFICATION/JUNE 1999 (05.V)
Motion by Mr. Blanton, seconded by Mayor Hutchins , that Council ratify the accompanying
check registers for accounts payable invoices paid on June 11, 1999 and June 18, 1999, in the
amount of $715,245.37. Carried unanimously.

Mr. Ehlert commented that a "self-contained" master planned development for the North 40 area with
housing, commercial, civic, and entertainment uses would have "no real impact" or harm in his opinion.
Commissioner Quintana wanted to clarify the process for the North 40 Specific Plan amendment and asked
staff whether it was appropriate to note the type of residential uses preferred or allowed (i.e. mixed use
residential over commercial, or housing geared toward younger residents without children). Mr. Bowman
clarified the order of the documents again (Le. adopt the N40 Specific Plan and then adopt the General Plan
with the inclusion of a requirement to amend the N40 Specific Plan to include residential), and affirmed that
it was appropriate for the General Plan Committee to make suggestions as to the type of residential uses.
Council Member Pirzynski restated that the purpose of the agenda item was to revisit the issue of including
residential uses in Policy 2-9 and that he felt there was a "open window" to reconsider or revisit this issue
considering the items/reasons behind the current General Plan policies. He further noted that these may not
be the sole issues Council considers regarding this policy.
Committee Member Muller asked whether the impact to the local school districts will be considered in the El R.
Mr. Bowman answered in the affirmative, but noted that the Town should have discussions with the district
before that point if residential is included in the North 40 area. Commissioner Decker emphasized that the
Town needs to remind the districts of their responsibility to provide school facilities.
Committee Member Smith stated that she was in favor of residential uses; did not want to limit the site only
to commercial uses; wanted to create a community in the North 40 area which took advantage of the
transportation node, higher density housing, loft units, and an active environment; and included civic, park,
and recreational open space uses.
Committee Member Ehlert moved to "include residential uses in the North 40 Specific Plan as part of the
General Plan Update." Chair Burke asked staff whether a developer who wanted to change the plan sooner
could pay for the environmental review and amendment process, could proceed earlier than the Town's
General Plan Update process. Mr. Bowman answered that this was correct.
Larry Arzie stated that it was his and other members of the community concern of "how to keep 40 acres of
asphalt from occurring" on the property that made them "push for residential (uses)", and that if another way
could be found to limit the development of 20-40 percent of the site, then alternatives to residential may be
acceptable. He further noted his opinion that the public doesn't want single family residential uses, but a "24
hour community". Commissioner Decker asked staff about the ability to limit portions of the site to open
space uses as part of the Plan.
Commissioner Nachison noted that the motion was to only study the inclusion of residential uses and that
it was not broad enough to include open space. She asked Mr. Ehlert to clarify his motion. Council Member
Lubeck noted that residential use is the only use not allowed and that almost everything else is allowed in
the area. Mr. Ehlert clarified that single family residential uses are a problem because they don't take
advantage of the transportation links, but that this was an opportunity for open space, commercial, and
live/work uses in the area. Mr. Arzie noted that this was a way to open the dialogue and get more public
input. Council Member Pirzynski stated that no members of the Town committees, boards, commissions, or
the Council want 40 acres of asphalt as depicted by Mr. Arzie.
Shirley Henderson noted that other uses such as the Hayes Mansion restaurant/conference center in San
Jose should be considered for the area not just regular retail/commercial stores. Joanne Talesfore noted that
something needs to be done to "loosen up" the commercial focus noted in the vision statement, and that
maybe mixed use residential, a senior center, a performing arts center, or schools could be included. Lee
Fagot supports looking at other alternatives, residential being one of approach to achieve a "Non -asphalt
greenway, or more greenery" (landscaping) for the area.

Committee Member Muller read the revised language from past General Plan Committee discussions on
the Specific Plan and noted that this should address the "too commercial" focus. Commissioner Quintana
noted her concern that Mr. Ehlert's motion is still too broad and would allow single family uses. Mr. Ehlert
noted that this was not his intent. Council Member Lubeck clarified that the Committee could decide what
type of residential to exclude as part of its recommendation to study the inclusion of residential uses, and
that this was the major issue. Ms. Muller noted for the record that the General Plan Task Force had a
desire for mixed -use and was against high density. Ms. Smith noted her desire for a "working/living
community" to create a neighborhood that works and that the Town should study other areas.
Ms. Lubeck clarified for the Committee that the motion as part of the General Plan Update was to study
residential uses in the North Forty area, and that the Committee could expand or narrow this by placing limits
on the residential uses. She further asked staff to clarify the process to change uses as part of the General
Plan Update. Mr. Curtis explained that the inclusion of new uses or changes in the draft document may
cause changes to the environmental reviews prepared for the administrative draft and could also require
changes in the consultants scope of work. Mr. Ehlert clarified for the Committee that his motion was to study
the inclusion of a "residential element" within the North Forty area and it is not his intent for the site to be
developed with all residential uses. The Committee unanimously approved Mr. Ehlert's motion 9-0.
