CONSIDER INTRODUCING ORDINANCE AMENDING TOWN CODE SECTION 24.10.020
TO CLARIFY ADVISORY AGENCY POWERS AND RESPONSIBILITIES
RECOMMENDATION:
1. Direct the Clerk to read the title of the proposed ordinance.
2. Waive further reading of the ordinance (requires unanimous vote).
3. Move to introduce the ordinance amending Town Code § 24.10.020 to clarify advisory agency
powers and responsibilities.
DISCUSSION:
When the Council adopted Ordinance No. 1963 on November 15, 1993, which amended a number
of provisions of the Town Subdivision and Zoning Codes, the Council asked that an amendment to Section
24.10.020 be brought back to make the section easier to read and understand.
The proposed ordinance would make no change in substance to the section, but would only clarify
that the Planning Commission is the Town's advisory agency under the State Subdivision Map Act
(Government Code § 66415). As the advisory agency, the Planning Commission is empowered to approve
all maps under the Subdivision Map Act except vesting tentative maps. For vesting tentative maps, the
Commission will make recommendations to the Council, which will then approve, disapprove, or conditionally
approve the vesting tentative map (Government Code § 66452.1).
FISCAL IMPACT: None
ENVIRONMENTAL ASSESSMENT: The proposed ordinance is a procedural clarification and not a project
under CEQA.

POWERS AND RESPONSIBILITIES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION I
Section 24.10.020 is amended to read as follows:
Section 24.10.020. Advisory agency; powers.
(a) The Planning Commission is the advisory agency for the Town under the
Subdivision Map Act and is authorized to approve, conditionally approve, or disapprove
all maps except vesting tentative maps.
(b) The Planning Commission will report to the Town Council on its
recommendations regarding vesting tentative maps but does not have authority to approve
or disapprove vesting tentative maps.
SECTION II
This ordinance was introduced at a regular meeting of the Town Council of the
Town of Los Gatos on , 1994 and adopted by the following vote as
an ordinance of the Town of Los Gatos at a regular meeting of the Town Council of the
Town of Los Gatos on , 1994. This ordinance takes effect 30 days
after it is adopted.

Motion by Mrs. Benjamin, seconded by Mr. O'Laughlin, that Council adopt Resolution 1993-
8 entitled, RESOLUTION OF THE TOWN OF LOS GATOS TO RE.IECT ALL BIDS AND TO
DETERMINE THAT THE TRUCK -MOUNTED CATCH BASIN & SEWER CLEANER IS A
UNIQUE AND SPECIALIZED ITEM. AND DIRECT STAFF TO SEEK A NEGOTIATED BID
FOR THE ITEM. Carried unanimously.

The Town Clerk read the Title of the Draft Ordinance.
Motion by Mrs. Benjamin, seconded by Mrs. Lubeck, that Council waive the reading of the Draft
Ordinance. Carried unanimously.
Motion by Mrs. Benjamin, seconded by Mrs. Lubeck, that Council introduce Draft Ordinance
entitled, ORDINANCE OF THE TOWN OF LOS GATOS ADDING A NEW SUBSECTION
2.30.025(F) TO AUTHORIZE THE TOWN COUNCIL TO DIRECT THE TOWN MANAGER
TO EXECUTE CONTRACTS ON BEHALF OF THE TOWN, Carried unanimously.
