SUBJECT: ADOPT A RESOLUTION ESTABLISHING FEES FOR DEVELOPMENT
APPLICATIONS THAT ARE REFERRED BACK TO THE PLANNING
COMMISSION AND A FEE FOR APPEALS OF DIRECTOR OF
COMMUNITY DEVELOPMENT AND DEVELOPMENT REVIEW
COMMITTEE DECISIONS.
RECOMMENDATION:
Adopt resolution (Attachment 1) establishing fees for development applications that are referred
back to the Planning Commission and a fee for appeals of applications approved by the DRC or
Director of Community Development.
DISCUSSION:
The Town Council considered this matter on December 18, 2000 and requested that staff revise the
resolution to include a provision allowing the Council to waive the 50% if an application is
remanded back to the Planning Commission. Attachment B is the revised resolution.
FISCAL IMPACT:
The proposed fees will increase revenue to the General Fund. The increase can not be predicted at
this time, but revenue will be adjusted as part of the third quarter report. Payments from applicants
will be handled in the same manner as new applications.

RESOLUTION 2000-
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING FEES FOR DEVELOPMENT APPLICATIONS THAT ARE REFERRED BACK
TO THE PLANNING COMMISSION BY THE TOWN COUNCIL AND ESTABLISHING
APPEAL FEES FOR APPEALS OF DIRECTOR OF COMMUNITY DEVELOPMENT AND
DEVELOPMENT REVIEW COMMITTEE DECISIONS.
WHEREAS, the Town has had an increase in the number of applications being appealed;
and
WHEREAS, a number of applications are being appealed to the Town Council and are
subsequently referred back to the Planning Commission for redesign; and
WHEREAS, applications that are referred back to the Planning Commission and those that
are appealed result in additional processing time and noticing costs; and
WHEREAS, development projects going through the process more than once are resulting
in costs not being recovered while Town's goal is full cost recovery for processing of development
applications; and
THEREFORE, BE IT RESOLVED: The Town Council hereby amends the Town Fee
Schedule to establish the following fees: (a) A fee of 50% of the original planning application fee
for processing applications that are referred from the Town Council to the Planning Commission,
except when the Town Council determines that the Planning Commission erred in its decision; and
(b) A fee of $50 for appealing a decision of the Director of Community Development or
Development Review Committee (DRC).
FURTHER RESOLVED: The Town Council shall have the authority to waive the 50%
remand fee if it determines this to be an appropriate action.
FURTHER RESOLVED: This resolution shall take effect 60 days from the date of
adoption.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 18th day of December, 2000 by the following vote:

Motion by Mr. Attaway, seconded by Mr. Glickman, that Council ratify the check registers for the
payrolls of November 26 through December 9, 200, paid on December 15, 2000 and December 10,
2000 through December 23, 2000, paid on December 29, 2000, in the amount of $470,466.78.

TRAFFIC SIGNAL LIGHT BULB REBATE/PG&E PROGRAM (09.41)
Motion by Mr. Attaway, seconded by Mr. Glickman, that Council authorize Town participation in
PG&E's LED rebate program; award bid for supply of LED traffic signal bulbs to Fortel
Communications in the amount of $93,451.43; accept quote from SMUPeek to install LED traffic
signal bulbs in the amount of $12,540; and authorize project budget as noted in Building Maintenance
Fund (Fund 695). Carried by a vote of 4 ayes. Mr. Blanton absent.
