08 Staff Report - Loan Receipt With Artist Philip LangeCOUNCIL AGENDA REPORT DATE: MARCH 18, 2003 TO: MAYOR AND TOWN COUNCIL FROM: DEBRA J. FIGONE, TOWN MANAGER SUBJECT: MEETING DATE: 4/7/03 ITEM NO. • ADOPT RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE THE LOAN RECEIPT WITH ARTIST PHILIP LANGE RECOMMENDATION: Adopt the attached resolution authorizing the Town Manager to execute the loan receipt for the sculpture, "Los Gatos Pescado" by Philip Lange, to be installed above the Community Bulletin Board Kiosk on the corner of Main St. and Fiesta Way for up to two years. BACKGROUND: In October 2001, the Town Council approved the recommendation from the Art Selection Panel and the Arts Commission to accept the loan of artwork from artists Marilyn Kuksht and Philip Lange. Marilyn Kuksht's piece "Portals and Passages" was installed on the Civic Center lawn on June 22, 2002. Phil Lange's installation, a 10' stand alone fish mounted on a 12' pole, was also to be located on the Civic Center lawn. During the design process, the sculpture and its size were re-evaluated, and the artist designed a smaller fish. The Art Selection Panel and the Arts Commission approved the artist's new design and his recommendation of installing it on the kiosk. The kinetic sculpture, "Los Gatos Pescado," is 4'6" long and will be placed two feet above the kiosk. It is constructed of steel and weighs 28 pounds. DISCUSSION: In preparation for the installation of this piece, the following has been accomplished. 1. The Town's Facilities Coordinator and a Building Inspector have met with the artist and approved the location of sculpture and the artist's plans for the sculpture and its installation. 2. The artist signed a Town of Los Gatos Loan Receipt, the Town of Los Gatos Release of Liability, Assumption of Risk and Indemnity Agreement, the Conditions of Loan. (Exhibits A-C) 3. The Art Selection Panel and the Arts Commission have approved the sculpture. March 18, 2003 4. The Art Selection Panel recommended that any further improvements to the kiosk be postponed until after the sculpture is installed. These improvements may include painting the kiosk, installation of a Community Bulletin Board sign, and a plaque with the artist's name and the sculpture's title. Upon Council's adoption of the resolution to execute a loan receipt ( Exhibit A) with Philip Lange, and the final inspection of the piece, the sculpture can be scheduled for installation. The installation will be completed by the artist and approved by the Building Inspector. CONCLUSION: The installation of Philip Lange's sculpture "Los Gatos Pescado," will be the latest addition to the Town's public art loan program and will meet objectives stated in the Town's Strategic Plan. It also represents the cooperative efforts of the Town, the artist, and community members to maintain our Town's unique character and appearance. ENVIRONMENTAL ASSESSMENT: The installation of this sculpture, "Los Gatos Pescado," is not a project defined under CEQA and no further action is required. FISCAL IMPACT: The expense of the artist's reception will be paid from the Community Services Operating budget, and the kiosk improvements are budgeted in the Building Maintenance Fund.
