FIRST PRIORITY FOR THE USE OF AVAILABLE TOWN FACILITIES AS
POLLING PLACES.
RECOMMENDATION:
Adopt Resolution giving the Registrar of Voters Office first priority for the use of available Town
facilities as polling places.
DISCUSSION:
The Registrar of Voters Office is requesting that each City/Town in the County adopt the attached
Resolution in preparation for their public relations campaign relating to the new Federally mandated
electronic voting process which is now in place in Santa Clara County. Election Code 12282 states
that, "Property exempted from taxation pursuant to Section 214 of the Revenue and Taxation Code
shall be made available free of charge to the elections official for use as a polling place pursuant to
Section 213.5 of the Revenue and Taxation Code.
The Town has always accommodated the Registrar of Voters Office in the past by allowing the use
of the Neighborhood Center as a polling place for any Primary, General, or Special elections.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GIVING THE REGISTRAR OF VOTERS OFFICE
FIRST PRIORITY FOR THE USE OF AVAILABLE TOWN FACILITIES
AS POLLING PLACES.
WHEREAS, the Santa Clara County Registrar of Voters is charged with the conduct
of elections, and part of that responsibility includes the recruitment and retention of polling places;
and,
WHEREAS, the Registrar of Voters Office needs government owned facilities to be
dependably available for use as polling places for each election, so that the Registrar of Voters can
more efficiently provide the services mandated under the law; and,
WHEREAS, the voters in Santa Clara County like to be able to access the same
polling place for each election, and when their polling place is changed it causes concerns; and,
WHEREAS, Election Code 12282 states that, "Property exempted from taxation
pursuant to Section 214 of the Revenue and Taxation Code shall be made available free of charge
to the elections official for use as a polling place pursuant to Section 213.5 of the Revenue and
Taxation Code"; and,
THEREFORE, BE IT RESOLVED, that the Registrar of Voters Office is granted,
upon availability, the use of appropriate Town property to be used as a polling place pursuant to
Election Code 12282.
PASSED AND ADOPTED at a regular meeting of the Los Gatos Town Council on
the 16`h day of June, 2003 by the following vote:
