Requesting preliminary review of a proposal for a Specific Plan amendment to the North Forty Specific Plan for construction of a commercial building on property zoned North Forty Specific Plan. APN 424-07-060 ROLE OF THE CDAC: The Conceptual Development Advisory Committee (CDAC) advises a prospective applicant on the overall consistency of a project with Town policies prior to submitting a formal application and investing in the development review process. The CDAC also endeavors to identify the potential issues that will need to be addressed during the development review process should the applicant wish to submit an application. The issues identified by the CDAC are not intended to be all-inclusive and other additional issues may be identified during the formal development review process. None of the CDAC's comments are binding on the Town and in no way are they intended to indicate whether the project will be received favorably by the various review bodies that are charged with evaluating and deciding the application. As noted in this report, if an application is filed, technical analysis would need to be done during the evaluation of the proposal. In addition, public input is a required and essential component in the development review process. Notice has been sent to residents and property owners within 300 feet of the project site. In addition to the public comments received at this meeting, all applicants are strongly encouraged to hold neighborhood meetings to receive input as the design of the project evolves should they decide to proceed with the development review process. The subject property is zoned North Forty Specific Plan and is primarily located within the Perimeter Overlay Zone of the Lark District. Future development of the site as proposed would require an amendment to the North Forty Specific Plan and an Architecture and Site application, which would be subject to the Design Guidelines contained within the North Forty Specific Plan. Key elements of the proposed project, as listed in the project description and on the plans submitted, are as follows: • Demolition of the existing mini-mart and auto service bay; • Construction of a two-story 5,847-square foot building with a with a mini-mart servicing the gas station on the first floor and offices on the second floor; and • An amendment to the North Forty Specific Plan to allow for exceptions for the gas station use, building height and setbacks, open space requirements, and the required number of parking spaces and their location. EXISTING GENERAL PLAN, ZONING, SPECIFIC PLAN DESIGNATION, AND PLANNING AREA: 1. General Plan land use designation: Mixed Use Commercial, which permits a mixture of retail, office, and residential in a mixed-use project, along with lodging, service, auto-related businesses, non-manufacturing industrial uses, recreational uses, and restaurants. Projects developed under this designation shall maintain the small town, residential scale and natural environments of adjacent residential neighborhoods, as well as provide prime orientation to arterial street frontages and proper transitions and buffers to adjacent residential properties. This designation should never be interpreted to allow development of independent commercial facilities with principal frontage on the side streets. 2. Surrounding General Plan land use designations: Mixed Use Commercial to the north, east, south, and west. 3. Zoning designation: North Forty Specific Plan. The Lark District is in close proximity to existing residential neighborhoods. Lower intensity residential and limited retail/office uses are envisioned for this area. Envisioned land use categories include: • Limited retail, personal services, and restaurants (primarily along Los Gatos Boulevard; • Office (along Los Gatos Boulevard); • Open space (pocket parks, paseos, orchard trees, and planting strips); and • Residential – Including condominium, cottage cluster/garden cluster housing, rowhouses, and townhomes. 4. Surrounding zoning designations: North Forty Specific Plan to the north and west, and CH (Restricted Highway Commercial) to the east and south. The project site is 13,852 square feet. 2. The project site is located on the northwest corner of Los Gatos Boulevard and Lark Avenue. 3. The project site contains an existing gas station, auto service bay, and mini-mart. POTENTIAL CONSIDERATIONS AND ISSUES: The following is a brief list of issues and topics for consideration by the CDAC. Staff has not reached conclusions on these topics. Staff is identifying them here to help frame the discussion and to solicit input. The main question for the CDAC is whether or not the applicant’s concept for the project creates a high-quality plan appropriate for Los Gatos in this location. If an application is filed, staff would evaluate the technical issues. 1. General Plan a. General Plan Policy LU-1.4 states, infill projects shall be designed in context with the neighborhood and surrounding zoning with respect to existing scale and character of surrounding structures, and should blend rather than compete with the established character of the area. b. General Plan Policy LU-1.8 states, commercial development of any type (office, retail, research and development, etc.) shall be designed in keeping with the small- town character of Los Gatos. c. Policy LU-2.1 states, minimize vehicle miles traveled for goods and services by allowing and encouraging stores that provide these goods within walking distance of neighborhoods in Los Gatos. d. General Plan Policy LU-6.5 states, the type, density, and intensity of new land use shall be consistent with that of the immediate neighborhood. e. Policy LU-7.3 states, infill projects shall contribute to the further development of the surrounding neighborhood (e.g. improve circulation, contribute to or provide neighborhood unity, eliminate a blighted area) and shall not detract from the existing quality of life. 2. North Forty Specific Plan 1) Zoning a. The existing gas station use is considered to be a non-conforming use as a gas station is not a permitted or conditionally permitted use in the North Forty Specific Plan. b. An office building is a permitted use in the Lark District of the North Forty Specific Plan. c. Every application for Architecture and Site review shall include the proposed project building floor area categorized by land use, new total developed building floor area categorized by land use, and a balance of allowed land use square footages. The total office/hotel use square footage has not been provided by the applicant but, the proposal would comply with the maximum allowable square footage. d. The maximum allowable building height is 35 feet or 25 feet when a building or portions of a building are located within 50 feet of Lark Avenue and Los Gatos Boulevard. The applicant has proposed a maximum building height of 34 feet, seven inches. The building is proposed to be approximately 36 feet, five and one- half inches from Lark Avenue and approximately 38 feet, one inch from Los Gatos Boulevard; which would not comply with the 25-foot height limit 50 feet from Lark Avenue and Los Gatos Bouelvard. e. In the Lark District, 15 percent of the overall development shall be structures of a maximum of two-stories with a 25-foot maximum height. The majority of this requirement may be provided within the Perimeter Overlay Zone. The proposal would not comply. f. The project does not comply with the minimum required side and rear setbacks. The minimum required setbacks in the Lark District for this parcel are: Front (Los Gatos Boulevard) – 30 feet (proposed at 38 feet, one inch). Side – 20 feet (proposed at four feet). Side abutting street (Lark Avenue) – 30 feet (proposed at 36 feet, five and one-half inches). Rear – 20 feet (proposed at three feet). In the Lark District, where non-residential development is located directly adjacent to a residential use, a 20-foot setback is required for the non-residential building. The proposal would not comply. g. The maximum allowable building coverage for a non-residential land use, including accessory structures is 50 percent. The square footage of the covered gas station pumps has not been provided by the applicant for staff to confirm if the proposal complies with or exceeds the maximum allowable lot coverage. 2) Open Space a. A minimum of 30 percent of open space is required through a variety of green- space and plaza spaces dispersed throughout the different districts. Remodels of existing structures along Los Gatos Boulevard that do not change more than 50 percent of the existing footprint are exempt from the 30 percent open space requirement. As proposed, the existing building is proposed to be demolished and the proposal would not be exempt from this requirement and would not comply. Properties located within the Perimeter Overlay Zone along Los Gatos Boulevard and Lark Avenue should utilize an orchard planting landscape buffer to reflect the agricultural heritage of the site. The proposal would not comply. 3) Parking a. The adequacy of parking will need to be considered based on the proposed uses. b. The proposed gas station and mini-mart uses require 9 parking spaces and the proposed second floor office uses require 10 parking spaces for a total of 19 parking spaces. The applicant proposes to provide 12 parking spaces and would not comply. c. Parking is not permitted within primary frontage setbacks with the exception of Los Gatos Boulevard. Parking on Los Gatos Boulevard may encroach up to five feet into the 30-foot setback for no more than a 100-foot span. Parking space 1 is proposed to be located more than five feet into the 30-foot setback along Los Gatos Boulevard and parking space 12 is proposed within the right-of-way along Lark Avenue. Space 1 and 12 do not comply with these requirements therefore, only 10 parking spaces would be provided. 3. Traffic a. A traffic analysis will determine whether a traffic study or mitigation fees will be required. If the project generates an additional five or more peak hour trips, a traffic analysis may be required. It is comprised of a new Minimart on the First Floor as well as new Office Suites on the Second Floor. The development will replace the existing (1) story minimart. The site is located within the City of Los Gatos’ Perimeter Overlay Zone and the Lark District of the ‘North 40 Specific Plan’ Zoning. We request for specific plan amendments to the following sections / tables under ‘North 40 Specific Plan: Section / Table Required regulation Section 2.4.3 Non-conforming use: existing gas station is not permitted. x Request for existing Gas Station to remain until the expiration of its Gas Supply Lease. Small and odd shape site plus ongoing Gas Supply Lease. The existing Gas Station and its Minimart were built in 1959 based on the City of Los Gatos’ Municipal Code at that time. The current North 40 Specific Plan is starkly more stringent than the City’s Municipal Code in 1959. The setback, parking, open space and use requirements of the current Plan, were it to be implemented on this site will make the site undevelopable because the site is small and is of odd shape, coupled with the Owner’s inability to remove the Gas Station at this particular time due to his contractual obligation to maintain the Gas Supply Lease until its expiration in approximately 10 years’ time. After the expiration of the said Lease, the Owner will completely remove the Gas Station and its associated underground tanks and equipment for new open space including green space, additional parking and other uses. Future use, if any and as well as the new open space shall be in compliance with the Specific Plan. 2. (2) Existing public bus stops nearby There are 2 existing public bus stops nearby. Bus stop A is about 500’ away, while bus stop B is about 350’ away. We are requesting for the reduction in the proposed parking spaces, based on the existence of the existing public bus stops nearby, in addition to the constraints of the site per item (1) above. Aesthetic enhancement, urban vitality and viability and economic growth. The current massing and architectural style of the existing Gas Station and the Minimart are unsightly. Replacing the existing minimart with our proposed new commercial - retail building will provide a much more aesthetically pleasing building image and improve the aesthetic streetscape along Los Gatos Boulevard and Lark Ave. This development will also enhance the urban vitality and viability of the town of Los Gatos in addition to helping promote its economic growth. 4. Owner’s discussion with City of Los Gatos re. the impact of the City’s Specific Plan prior to its adoption. The Owner had brought to the attention of the City of Los Gatos’ Planning Department regarding the severe negative impact of the Specific Plan onto this Site as early as during the City’s Town Hall discussions with the public prior to the adoption of the Specific Plan. Therefore, the City is aware of the Owner’s plight and has stated its willingness to resolve the issue to the satisfaction of both parties. This proposed building is actually worse than the gas station. I wonder if he has read the boulevard master plan. I doubt he is from here I do not recognize his name. Please do not approve this project. This intersection is the busiest in town as so many cars are trying to get on or exiting from highway 17. The town spent a lot of money putting the overhead wires underground and widening the street.
