SUBJECT: INTRODUCE AMENDMENTS TO DIVISION 4, CONFLICT OF INTEREST, SECTIONS
2.30.605 THROUGH 2.30.700 OF THE TOWN CODE
RECOMMENDATION:
Introduce amendments to the Conflict of Interest Section of the Town Code.
1. Discuss the need for amendments to the current Ordinance.
2. Waive the reading of the Draft Conflict of Interest Ordinance.
3. Introduce amended Conflict of Interest Code.
4. Approve policy having Town contracts with consultants contain a statement regarding the
need for financial disclosure.
5. Authorize transfer of $500.00 for copy and mailing costs from unrestricted reserves to the
Town Clerk's budget account 1056-60510.
BACKGROUND:
The Council considered this matter at their meeting of September 8, 1992 and returned the matter for Staff
review.
DISCUSSION:
All departments have reviewed the list of designated employees and have recommended deletions of certain
staff members. Parks/Forestry/Maintenance have indicated that the three remaining designated employees
should file categories 1 through 10 (excluding category 9) and Planning has added categories 3 & 5. ALL
departments have made some deletions which are indicated by the "line through" on the designated
positions list. It has also become apparent that Category 6 is somewhat repetitive of Category 5 and
therefore should be removed as a Category designation. The Ordinance has been amended to include
a provision indicating that Employees, Board or Commission Member who sit on more than one Town
Commission, need only file once. Examples are Planning Commission Members who also serve on Historic
Preservation Committee. It is also important to note that although the Redevelopment Agency requires a
separate Conflict of Interest Code, it is not necessary for any individual to file separate documents.
The Conceptual Development Advisory Committee has been deleted because all are Council or
Commission members and would be filing under their respective designations. The Redevelopment
Advisory Committee will be removed from the Town Ordinance and placed in the Redevelopment Agency.
None of the other Commissions and/or Town Boards have been deleted and Council will need to address
this issue.

The Town Clerk's Office has forwarded a Local Agency Biennial Report indicating that Council has the Code
revision under review.

Office priorities will be adjusted to allow staff time to complete this project.
Exhibit A: Document acknowledging either the need to amend our present
code or reporting that no amendment is necessary.
Exhibit B: Our original Town Code with proposed amendments.
Exhibit C: Ordinance with amendments to be introduced. Section 2.30.625
includes statement regarding the necessity of filing only once.
Exhibit D: Letter forwarded to FPPC and Local Agency Biennial Report.
