INTEREST CODE (DIVISION 6 OF ARTICLE III OF CHAPTER 4) TO UPDATE PLANNING
DEPARTMENT CLASSIFICATIONS
RECOMMENDATION:
1. Direct Clerk to read the title of the proposed ordinance.
2. Waive further reading of the ordinance.
3. Introduce ordinance.
DISCUSSION:
In 1995, the Town reclassified the Planner I and II positions to Associate Planner and Assistant Planner. The Town
Conflict of Interest Code, found in Sections 2.30.605 and following, specifies the officers and employees that are
required to file Statements of Economic Interest under the State Political Reform Act. In order to keep the Town's Code
current, it is recommended that the Planning Department listing be amended to change Planner I/II to Associate Planner
and Assistant Planner. The disclosure requirements for the positions will remain the same.

ORDINANCE OF THE TOWN OF LOS GATOS AMENDING
THE TOWN'S CONFLICT OF INTEREST CODE (DIVISION 4 OF ARTICLE III OF
CHAPTER 2) TO UPDATE PLANNING DEPARTMENT CLASSIFICATIONS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION I
The Town Conflict of Interest Code needs to be amended in order to update its provisions with
regard to two Planning Department positions that have been reclassified. This ordinance makes
no change in the substance of the Conflict of Interest Code, but only renames the two
classifications involved.
SECTION II
Section 2.30.610 is amended to read as follows with regard to PLANNING DEPARTMENT:
Sec. 2.30.610. Designated employees.

SECTION III
This ordinance was introduced at a regular meeting of the Town Council of the Town of

Town of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos on
, 199_. This ordinance takes effect 30 days after it is adopted.

to do certain things at their own meeting because they did not have that discretion, and because
of the Permit Streamlining Act they had to either go forward or totally deny the project. Under
the circumstances Planning Commission did what was appropriate for them to do. Also the
individual findings will all be placed in resolution which Council may review at the meeting of
February 5, 1996. Carried unanimously.
VASONA HEIGHTS BENEFIT ZONE/LANDSCAPING & LIGHTING DISTRICT
RESOLUTION 1996- 7/RESOLUTION 1996-8 (21.14)
Motion by Mrs. Lubeck, seconded by Mr. O'Laughlin, that Council adopt Resolution 1996-7
entitled, RESOLUTION OF THE TOWN OF LOS GATOS OF INTENTION TO CREATE AND
ANNEX THE VASONA HEIGHTS AREA INTO LANDSCAPING AND LIGHTING DISTRICT
1. DESIGNATED AS VASONA HEIGHTS BENEFIT ZONE. AND ESTABLISH A POLICY ON
CAPITAL REPLACEMENT AND CREATE A RESERVE ACCOUNT FOR PREEXISTING
FUNDS IN OPEN SPACE MAINTENANCE DISTRICT 3, Carried by a vote of 4 ayes. Mrs.
Benjamin was absent.
Motion by Mrs. Lubeck, seconded by Mr. O'Laughlin, that Council adopt Resolution 1996-8
entitled, RESOLUTION OF THE TOWN OF LOS GATOS OF INTENTION TO ADOPT AN
ORDINANCE DISSOLVING OPEN SPACE MAINTENANCE DISTRICT 3. Carried by a vote
of 4 ayes. Mrs. Benjamin was absent.
Motion by Mrs. Lubeck, seconded by Mr. O'Laughlin, that Council accept engineer's report on
Fiscal Year 1996-97 Maintenance Cost. Carried by a vote of 4 ayes. Mrs. Benjamin was absent.
The Town Clerk read the Title of the Draft Ordinance.
Motion by Mrs. Lubeck, seconded by Mr. O'Laughlin, that Council waive the reading of the
Draft Ordinance. Carried by a vote of 4 ayes. Mrs. Benjamin was absent.
Motion by Mrs. Lubeck, seconded by Mr. O'Laughlin, that Council introduce Draft Ordinance
entitled, QRDINA'NCE OF THE TOWN OF LOS GATOS DISSOLVING TOWN OF LOS
GATOS OPEN SPACE MAINTENANCE DISTRICT 3 ON CONDITION THAT A
LANDSCAPING AND LIGHTING DISTRICT BENEFIT ZONE BE ESTABLISHED AND THAT
CERTAIN USES BE MADE WITH THE FUNDS REMAINING IN THE OPEN SPACE
MAINTENANCE DISTRICT 3 ACCOUNT, Carried by a vote of 4 ayes. Mrs. Benjamin was
absent.

ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING DIVISION 4, SECTION 2.30.6010
RELATING TO CONFLICT OF INTEREST CODE
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY
ORDAIN:
SECTION I
Section 2.30.610 of the Conflict of Interest Code is amended to read:
Sec. 2.30.610. Designated employees.
This section shall constitute the appendix referred to in section 2 of the
standardized conflict of interest code. The Council hereby finds that the officers and
employees holding the following designated positions make, or participate in the making
of decisions which may foreseeably have a material effect on financial interests, and are
therefore designated employees of the Town of Los Gatos and are required to make
financial disclosure.

This ordinance was introduced at a regular meeting of the Town Council of the Town
of Los Gatos on December 7, 1992 and adopted by the following vote as an ordinance of
the Town of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos
on January 4, 1993.
