Requesting preliminary review of a proposal to request a Variance to allow a drive-thru use at an existing restaurant (McDonald’s) on property zoned CH. APN 424-19-065. ROLE OF THE CDAC: The Conceptual Development Advisory Committee (CDAC) advises a prospective applicant on the overall consistency of a project with Town policies prior to submitting a formal application and investing in the development review process. The Committee also endeavors to identify the potential issues that will need to be addressed during the development review process should the applicant wish to submit an application. The issues identified by the Committee are not intended to be all-inclusive and other additional issues may be identified during the formal development review process. None of the Committee's comments are binding on the Town and in no way are they intended to indicate whether the project will be received favorably by the various review bodies that are charged with evaluating and deciding the application. As noted in this report, if an application is filed, technical analysis would need to be done during the evaluation of the proposal. In addition, public input is a required and essential component in the development review process. Notice has been sent to residents and property owners within 300 feet of the project site. In addition to the public comments received at this meeting, a ll applicants are strongly encouraged to hold neighborhood meetings to receive input as the design of the project evolves should they decide to proceed with the development review process. PAGE 2 OF 4 SUBJECT: 15475 Los Gatos Boulevard/CD-20-006 DATE: November 30, 2020 N:\DEV\CDAC\CDAC Reports and Attachments\2020\12-09-20\Item 2 - 15475 Los Gatos Blvd\Item 2 - Staff Report with Attachments.docx PROJECT DESCRIPTION: The applicant has submitted a project description (Attachment 3), a set of conceptual drive- thru signage renderings (Attachment 4), and a set of conceptual plans (Attachment 5) for 15475 Los Gatos Boulevard, a 1.3 acre property located on the west side of Los Gatos Boulevard, south of Gateway Drive and north of Los Gatos-Almaden Road. The applicant proposes to add a drive- thru use to the existing restaurant (McDonald’s) to provide contactless ordering and service to customers during the COVID-19 pandemic. In addition, the applicant proposes that the addition of a drive-thru window would increase revenue for the existing business as the State and County COVID-19 pandemic related health measures limit and reduce indoor seating opportunities. Pursuant to Town Code Section 29.10.045 drive-in restaurant uses are prohibited in all zones. The property is zoned CH. Key elements of the proposed project are as follows: • Permitting a drive-thru restaurant use at an existing restaurant; • Reconfiguring the existing parking lot to accommodate a drive-thru lane and circulation; and • Eliminating 15 existing parking spaces. EXISTING GENERAL PLAN, ZONING, SPECIFIC PLAN DESIGNATION, AND PLANNING AREA: 1. General Plan designation: Mixed Use Commercial 2. Surrounding General Plan designations: Mixed Use Commercial on all sides. 3. Zoning designation: Restricted Highway Commercial (CH). 4. Surrounding zoning designations: CH on all sides. EXISTING CONDITIONS: 1. The project site is 1.3 acres (58,125 square feet). 2. The project site contains an existing 4,267 square foot one-story restaurant building, outdoor seating, and an associated parking lot. BACKGROUND: On August 1, 1977, the Town Council adopted Ordinance No. 1363, adding a section to the Town Code prohibiting specific uses in all zones, including drive-in restaurant uses. On December 15, 1976, the Town Architecture and Site Committee approved Conditional Use Permit (CUP) applications U-76-18 and U-76-18A to allow a restaurant use (McDonald’s) with the sale of packaged foods and non-alcoholic beverages for consumption on- and off-site. On December 12, 1984, the Planning Commission denied CUP application U-76-18B, requesting PAGE 3 OF 4 SUBJECT: 15475 Los Gatos Boulevard/CD-20-006 DATE: November 30, 2020 N:\DEV\CDAC\CDAC Reports and Attachments\2020\12-09-20\Item 2 - 15475 Los Gatos Blvd\Item 2 - Staff Report with Attachments.docx BACKGROUND (continued): approval of plans to modify the use of an existing restaurant (McDonald’s) to include drive-thru food service and to make exterior modifications to the building to accommodate this change of use. Public testimony expressed concerns regarding potential air pollution from idling cars, traffic congestion, and noise pollution. A member of the public expressed support of the proposed drive-thru to increase accessibility for people with disabilities. In March of 1999, an inquiry was sent to the Planning Department requesting the addition of a drive-thru window at the subject site. The Planning Director provided a letter stating that Town policy did not allow drive-thru uses as part of a fast food restaurant, pursuant to Town Code Section 29.10.045, prohibiting drive-in restaurants. The Jack in the Box drive-thru restaurant located at 15711 Los Gatos Boulevard predates this policy. The letter states the policy was intentionally adopted due to concerns about air quality from idling car engines and traffic. POTENTIAL CONSIDERATIONS AND ISSUES: The following is a brief list of issues and topics for consideration by the CDAC . Staff has not reached conclusions on these topics. Staff is identifying them here to help frame the discussion and to solicit input. The main question for the CDAC is whether or not the applicant’s concept for the project creates a high-quality plan appropriate for Los Gatos in this location. If an application is filed, staff would evaluate the technical issues. 1. Use a. Pursuant to Town Code drive-in restaurant uses are prohibited in all zones. b. Will the proposed drive-thru restaurant use be appropriate for this site? c. Based on the current project description, the proposal to allow a prohibited use will require a Variance application and a Modification of an existing CUP application. d. The deciding body for a Variance application is the Planning Commission. e. Can the required Findings for a Variance application be made? i. Because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of this ordinance deprives such property of privileges enjoyed by other properties in the vicinity and under identical zone; and ii. The granting of a variance does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone which such property is situated. 2. Parking/Circulation a. Will adequate parking be provided? i. The existing site has 92 parking spaces. The proposed project will remove 15 spaces resulting in a total of 77 parking spaces provided on-site. Per Town Code the existing and proposed use require a total of 19 on-site parking spaces. An arborist report will be required during development review to evaluate the potential impact to trees. b. Will the parking lot reconfiguration be designed to avoid tree impacts? c. Will underground electrical utility lines impact trees? d. Will adequate parking lot landscaping be provided? 4. Traffic a. A traffic analysis will determine whether a traffic study or mitigation fees will be required. If the project generates an addition of five or more peak trips, traffic mitigation fees will be required. 5. Environmental a. Will noise be an issue? b. Will air quality be impacted? c. Will greenhouse emissions be increased? 6. Accessibility a. Will the proposed use provide additional accessibility to the public? The Committee will meet once a month on a regular schedule (time and date to be determined by Committee members). 2. The Committee shall consist of three Planning Commissioners and two Town Council persons. 3. Only one item will be permitted on each agenda. 4. A prospective developer shall submit at his/her option, a "Request For Review" which shall include: a. A signed application form available from the Community Development Department. The property owner must sign the application or it will not be accepted. b. A brief, general description of the project and its location (no more than one typed page-double spaced). c. Thirteen (13) copies of a preliminary site plan. Schematic elevations are encouraged, but are not required. The more information provided to the Committee, the more detailed the responses will be. Full size plans are recommended for very complex or large projects. d. Required filing fee. e. All materials (plans, letters, etc.) intended to be viewed by the Committee members prior to the meeting must be submitted at the same time the application is filed. Materials filed after the submittal will not be accepted. Materials may be brought to the meeting. 5. The prospective developer has five minutes to make a presentation and the Committee has 25 minutes to respond. 6. Committee members will give their own personal opinion about the project. The applicant shall not argue about that opinion or try to dissuade Committee members. 7. The Committee may only review a project once prior to a formal application being submitted. 8. If, after a formal submittal to the Town, the scope of the p roject changes significantly, the applicant may resubmit to the CDAC at the discretion of the Director of Community Development. 9. A Committee agenda will be mailed and posted 72 hours before the meeting. The CDAC is a publicly noticed meeting. 10. Minutes will be taken for the Committee meeting; however, the meeting will not be recorded. 11. There will be an action letter mailed out advising the prospective developer of the Committee's list of concerns and comments. New order and pick-up windows will be installed on the eastern side of the building but will not alter the exterior design. The existing ADA parking stalls facing Los Gatos Blvd will be reconfigured to fit the new drive-thru lane. Several parking stalls on the south side of the property will be removed to accommodate the drive-thru, but there are more than enough parking remaining to meet code. The entrance to the drive-thru will be marked by a gateway sign and clearance bar, see attached specification. There are 2 sets of ordering points laid out in a tandem configuration, one in front of the other. Each order station will have an order canopy with built in speaker box and an outdoor digital menu board, see attached specifications. Pavement markings like arrows and drive-thru signs will help guide the vehicular flow within the property. McDonald’s is proposing to add drive-thru in this location to meet the increasing demand for drive-thru ordering, most evident during the recent pandemic. Allowing drive-thru use in the restaurant will provide the community the option to order food in a safer and healthier way. The effects of the pandemic to the user’s needs and behavior requires a change in the existing built environment. Patrons are demanding contactless ordering to reduce the risk of being infected with Covid-19. The addition of drive-thru will also assist in increasing revenue for the restaurant since the business has been impacted negatively by mandatory closure of the dining room.
