COMMITTEE OF THE TOWN OF LOS GATOS FOR DECEMBER 1, 2015 H ELD IN TH E TOWN

The meeting was called to order at 10:05 a.m. by Chair Machado.

PUBLIC HEARINGS
ITEM 1 : 215 Alexander A venue
Architecture and Site Application S-15-066
Requesting approval for a technical demolition of a pre-1941 single-family residence,
construction of a new single-family residence, and a detached accessory structure
with reduced setbacks on property zoned R-1 :8 . APN 510-15-006.
PROPERTY OWNER: Kip and Stacey Martin
APPLICANT: Gary Kohlsaat, Kohlsaat & Associates, Inc.
PROJECT PLANNER: Jocelyn Puga
1. Chair Machado opened the public hearing.
2. Staff gave report on proposed project.
3. Applicant was introduced.
4. Members of the public were present.
Janice and Ken Benjamin agreed that reduced setbacks should be allowed in certain cases
because otherwise wasted space is just created behind the structure.
5. Public hearing closed.
6. Doug Harding moved to approve the application subject to the conditions presented with the
following findings and considerations:
FINDINGS
Required finding for CEQA:
• The project is Categorically Exempt pursuant to the adopted Guidelines for the Implementation
of the California Environmental Quality Act, Section 15303: New Construction or Conversion of
Small Structures.

Required finding for the demolition of a single-family residence:
• As required by Section 29.10.09030(e) of the Town Code for the demolition of a single-family
residence:
1. The Town's housing stock will be maintained as the single-family residence will be replaced .
2. The existing structure has no architectural or historical significance.
3 . The property owner does not desire to maintain the structure as it exists; and
4 . While the majority of the structure will be maintained, the scope of the proposed remodel
requires removal of more than 50% of the existing wall area; which will result in a technical
demolition .
Required Compliance with the Residential Design Guidelines:
• The project is in compliance with the Residential Design Guidelines for single-family homes not
in hill si de residential areas.
CONSIDERATIONS
Required considerations in review of Architecture & Site applications:
• As required by Section 29.20.150 of the Town Code, the considerations in rev iew of an
Architecture and Site application were all made in reviewing thi s project.
Required consideration of the following criteria to aU ow the required rear yard of an accessory
structure to be reduced to three feet from a property line:
• As required by Section 29.40.015(b)(l) of the Town Code, the criteria required to allow the
required side yard of an accessory structure (detached garage) to be reduced to three feet
from the property line were made in reviewing the project.
