12-12-06 Minutes - DRC TOWN OF LOS GATOS 110 East Main Street, Los Gatos, CA 95032 (408) 354-6872 -------------------------------------------------------------------------------------------------------------------------- SUMMARY MINUTES OF A REGULAR MEETING OF THE DEVELOPMENT REVIEW COMMITTEE OF THE TOWN OF LOS GATOS FOR DECEMBER 12, 2006 HELD IN THE TOWN COUNCIL CHAMBERS, CIVIC CENTER, 110 EAST MAIN STREET, LOS GATOS, CALIFORNIA. -------------------------------------------------------------------------------------------------------------------------- The meeting was called to order at 9:00 AM. by Chair Baily. ATTENDANCE Members Present: Sandy Baily, Associate Planner Suzanne Davis, Associate Planner Joel Paulson, Associate Planner Wayne Hokanson, Fire Department Anthony Ghiossi, Senior Building Inspector Fletcher Parsons, Associate Engineer Elizabeth Pettis, Assistant Planner PUBLIC HEARINGS ITEM 1: 17005 and 17017 Roberts Road Architecture and Site Applications S-07-22 through S-07-28 Subdivision Application M-07-11 Requesting approval of a seven lot residential subdivision, lot line adjustment, to demolish a single family residence, to demolish a 3-unit apartment building built prior to 1941, and to construct seven new single family residences on property zoned RM:5- 12:PD. APN 529-16-021 and 045 PROPERTY OWNER: Khurram Iqbal APPLICANT: Donna and Louie Leu 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced. 4. Members of the public were not present. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: (a) No significant environmental impacts were identified as a result of this project and a Mitigated Negative Declaration was previously adopted; and (b) As required by Section 29.10.09030 (c) and (e) of the Town Code for the demolition of a single family home and an historic three-unit apartment building: Demolition of historic structures: The pre-1941 apartment building was found to have no special historical, architectural or aesthetic interest or value. Architecture and Site findings for a demolition: DRC Minutes December 12, 2006 1. The Town=s housing stock will be maintained in that there will be a net increase of three housing units. 2. As stated above, the pre-1941 apartment building was found to have no special historical, architectural or aesthetic interest or value. The house to be removed is not historic. 3. The property owner has no desire or capacity to maintain the structure. 4. Based on the findings of a structural report, there is no economic utility to upgrade the buildings. (c) The project is in conformance with the considerations for Architecture and Site applications as set forth in Section 29.20.150 of the Zoning Ordinance; and (d) None of the findings can be made, as required by Section 66474 of the State Subdivision Map Act, to deny a subdivision, and (e) The proposed project is consistent with the approved Planned Development. 7. Ghiossi seconded, motion passed unanimously. 8. Appeal rights were cited. ITEM 2: 15054 Blossom Hill Road Architecture and Site Application S-07-32 Requesting approval of a pool, sport court and landscape improvements on property zoned HR-1. APN 527-16-015 PROPERTY OWNER: Gregory Dudey & Dawn Hill APPLICANT: Zachiah Murray 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced. 4. Members of the public were present: Shawn Imai, neighbor, had no objections to the plan. Imai discussed drainage and construction parking concerns which are currently addressed through the conditions of approval. 5. Public hearing closed. 6. Ghiossi moved to approve the application subject to the conditions presented with the following findings and considerations: (a) The project is Categorically Exempt from environmental review pursuant to Section 15303 of the State Environmental Guidelines as adopted by the Town. (b) The proposed project is in compliance with the Town=s Hillside Development Standards & Guidelines. (c) As required by Section 29.20.150 of the Town Code, the considerations in review of an Architecture and Site application were all made in reviewing this project. 7.
