ATTENDANCE Members Present: Sandy Baily, Associate Planner Joel Paulson, Associate Planner Judie Gilli, Assistant Planner Julie Linney, Fire Department Mark Glendinning, Building Inspector Fletcher Parsons, Associate Engineer Rachel Peled, Assistant Planner PUBLIC HEARING ITEM 1: 16470 Shannon Road Architecture and Site Application S-06-04 Requesting approval to demolish a single family residence and to construct a new residence on property prezoned R-1:8. APN 532-04-031. PROPERTY OWNER: Jerome Park APPLICANT: DeMattei Construction, Steven W. Plyler 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced. 4. Members of the public were not present. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: (a) That the proposed project is categorically exempt, pursuant to Section 15303 of the California Environmental Quality Act as adopted by the Town; and (b) As required by Section 29.10.09030(e) of the Town Code, for the demolition of the existing single family residence 1. The Town’s housing stock will be maintained because a new house is proposed; and 2. The existing structure is not historically or architecturally significant; and 3. The property owner does not want to maintain the existing structure; and 4. The economic utility of the building has been exceeded. (c) That the project is in conformance with the considerations for Architecture and Site applications as set forth in Section 29.20.150 of the Zoning Ordinance. 7. Glendinning seconded, motion passed unanimously. 8. Appeal rights were cited. PUBLIC HEARING ITEM 2: 105 Stony Brook Road Architecture and Site Application S-06-010 Requesting approval of a technical demolition and to construct a new single family residence on property zoned R-1:10. APN: 532-08-031 PROPERTY OWNER/APPLICANT: Mark Shasheen Sr. 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced. 4. Members of the public were present: Brian Hedayati, neighbor, requested that additional shrubs be planted and the proposed trees be shifted to provide screening. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented and modified to meet the neighbor’s concern, with the following findings and considerations: (a) That the application is Categorically Exempt from CEQA, Section 15303. (b) That the considerations required by Sec. 29.20.150 of the Town Code were all made in reviewing this application. (c) As required by Section 29.10.09030(e) of the Town Code for the demolition −3− of a single family residence: 1. The Town's housing stock will be maintained in that the house will be replaced. 2. The structure has no historic significance. 3. The property owner has no desire to maintain the structure. 4. The economic utility of the structure is in fair condition. 7. Peled seconded, motion passed unanimously. 8. Appeal rights were cited. ITEM 3: 150 W. Main Street Conditional Use Permit U-06-09 Requesting approval to operate a formula retail store (Jos A. Bank Clothiers) on property zoned C-2:LHP. APN 529-03-019. PROPERTY OWNER: Kathleen Gallo APPLICANT: Jos A. Bank Clothiers Deemed incomplete by Planning Division. Does not need to return to Development Review Committee. Tentatively scheduled for the Planning Commission meeting of January 25, 2006. ITEM 4: 54 Chester Street Architecture and Site Application S-05-031 Requesting approval to demolish a pre-1941 residence, construct a new single family residence and accessory structure with reduced setbacks and request an interpretation of the cellar policy on property zoned R-1D. APN: 529-08-008 PROPERTY OWNER: Anna Huynh and Kevin Crane Deemed incomplete by Planning Division. Does not need to return to Development Review Committee. Tentatively scheduled for the Planning Commission meeting of February 8, 2006. ADJOURNMENT Meeting adjourned at 9:45 A.M.
