11-30-04 Minutes - DRC TOWN OF LOS GATOS 110 East Main Street, Los Gatos, CA 95032 (408) 354-6872 ----------------------------------------------------------------------------- --------------------------------------------- SUMMARY MINUTES OF A REGULAR MEETING OF THE DEVELOPMENT REVIEW COMMITTEE OF THE TOWN OF LOS GATOS FOR NOVEMBER 30, 2004 HELD IN THE TOWN COUNCIL CHAMBERS, CIVIC CENTER, 110 EAST MAIN STREET, LOS GATOS, CALIFORNIA. ----------------------------------------------------------------------------- --------------------------------------------- The meeting was called to order at 9:05 A.M. by Chair Baily. ATTENDANCE Members Present: Sandy Baily, Associate Planner Julie Linney, Fire Department Anthony Ghiossi, Senior Building Inspector Fletcher Parsons, Associate Engineer Rachel Bacola, Planning Technician PUBLIC HEARING ITEM 1: 250 Almendra Avenue Architecture and Site Application S-05-028 Requesting approval of parking lot improvements which may require removal of a parking space to meet accessibility requirements on property zoned O:LHP. APN 510-14-020. PROPERTY OWNER: Richard Sermone APPLICANT: Terry Martin Associates 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were not present. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: a. The considerations required by Sec. 29.20.150 of the Town Code were all made in reviewing this application. b. The application is Categorically Exempt from CEQA, Section 15303. c. As required by Section 29.10.155 (m) of the Town Code, the public necessity for disabled-accessible parking spaces outweighs the need for the number of parking spaces. 7 Ghiossi seconded, motion passed unanimously. 8 Appeal rights were cited. PUBLIC HEARING ITEM 2: 1438 Pollard Road Conditional Use Permit U-05-011 Requesting approval to operate a restaurant (Baskin Robbins) on property zoned C-1. APN 407-33-021 and 023. PROPERTY OWNER: Rinconada 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were not present. 5. Public hearing closed. 6. Ghiossi moved to approve the application subject to the conditions presented with the following findings and considerations: a. As required by Section 29.20.190 of the Town Code for granting a Conditional Use Permit, DRC finds that: (1) The proposed use of the property is essential or desirable to the public convenience or welfare; in that it will provide a specialty snack shop to residents and visitors of Los Gatos. (2) The proposed use will not impair the integrity and character of the zone in that it is a permitted use. (3) The proposed use would not be detrimental to public health, safety or general welfare; in that conditions of approval have been applied to the overall operation of the use. (4) The proposed use of the property are in harmony with the various elements or objectives of the General Plan and the purposes of the Town Code. b. It has been determined that this project is Categorically Exempt −3− pursuant to Section 15301 of the State Environmental Guidelines as adopted by the Town. 7 Parsons seconded, motion passed unanimously. 8 Appeal rights were cited. ITEM 3: 402 More Avenue Conditional Use Permit U-04-0017 Requesting approval to install a wireless telecommunication facility on property zoned R-1:20. APN 407-04-003 PROPERTY OWNER: San Jose Water Company APPLICANT: Velocitel Deemed incomplete by Planning Division. Does not need to return to Development Review Committee Tentatively scheduled for the Planning Commission Meeting of January 12, 2005. ADJOURNMENT Meeting adjourned at 9:20 A.M.
