ATTENDANCE Members Present: Sandy Baily, Associate Planner Joel Paulson, Planner Judie Gilli, Assistant Planner Anthony Ghiossi, Senior Building Inspector Fletcher Parsons, Associate Engineer Rachel Bacola, Planning Technician ITEM 1: 615 Blossom Hill Road Architecture and Site Application S-05-30 Requesting approval of a time extension to construct 49 apartment units and a recreational building on property zoned RM:5-12:PD. APNS: 529-16-023, 073 and 529-14-012 PROPERTY OWNER: Steven Dilbeck and Cupertino Development Corporation APPLICANT: Cupertino Development Corporation Deemed complete, matter tentatively scheduled for the Planning Commission Meeting of December 8, 2004 as a consent item. PUBLIC HEARING ITEM 2: 16810 Loma Street Architecture and Site Application S-04-057 Requesting approval to demolish and construct a new single family residence and to relocate an accessory structure with reduced setbacks on property zoned R-1:8. APN 532-07-011. PROPERTY OWNER/APPLICANT: Vladimir Frank 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were present: Seymour Abrahams, neighbor: Stated his concerns have been mitigated. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: · As required by Section 29.20.150 of the Town Code for Architecture and Site applications. The considerations required by Sec. 29.20.150 of the Town Code were all made in reviewing this application. · As required by Section 29.10.09030(e) of the Town Code for the demolition of a single family residence: 1. The Town's housing stock will be maintained in that the house will be replaced. 2. The Historic Preservation Committee found that the structure has no historic significance. 3. The property owner has no desire to maintain the structure. 4. The economic utility of the structure is in fair condition. · The application is Categorically Exempt from CEQA, Section 15303. 7 Ghiossi seconded, motion passed unanimously. 8 Appeal rights were cited. PUBLIC HEARING ITEM 3: 16781 Chirco Drive Architecture and Site Application S-05-005 Requesting approval to demolish and to construct a new single family residence on property zoned R-1:8. APN 424-20-050. PROPERTY OWNER: Eric Koide et al APPLICANT: John Lien 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were present: John Kiely, neighbor who stated he was in favor of the proposed project. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: −3− · As required by Section 29.20.150 of the Town Code for Architecture and Site applications. Ghiossi moved to approve the application subject to the conditions presented with the following findings and considerations: · That the proposed project is categorically exempt, pursuant to Section 15303 of the California Environmental Quality Act as adopted by the Town. · That the project is in conformance with the considerations for Architecture and Site applications as set forth in Section 29.20.150 of the Zoning Ordinance. 7 Parson seconded, motion passed unanimously. −4− 8 Appeal rights were cited. PROPERTY OWNER: Gregory C. Walker APPLICANT: Dave Flick 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were not present. 5. Public hearing closed. 6. Linney moved to approve the application subject to the conditions presented with the following findings and considerations: · That the proposed project is categorically exempt, pursuant to Section 15303 of the California Environmental Quality Act as adopted by the Town. · That the project is in conformance with the considerations for Architecture and Site applications as set forth in Section 29.20.150 of the Zoning Ordinance. 7 Parsons seconded, motion passed unanimously. 8 Appeal rights were cited.
