07-20-04 Minutes - DRC TOWN OF LOS GATOS 110 East Main Street, Los Gatos, CA 95032 (408) 354-6872 ----------------------------------------------------------------------------- --------------------------------------------- SUMMARY MINUTES OF A REGULAR MEETING OF THE DEVELOPMENT REVIEW COMMITTEE OF THE TOWN OF LOS GATOS FOR JULY 20, 2004 HELD IN THE TOWN COUNCIL CHAMBERS, CIVIC CENTER, 110 EAST MAIN STREET, LOS GATOS, CALIFORNIA. ----------------------------------------------------------------------------- --------------------------------------------- The meeting was called to order at 9:10 A.M. by Chair Baily. ATTENDANCE Members Present: Sandy Baily, Associate Planner Melanie Chase, Fire Department Anthony Ghiossi, Senior Building Inspector Fletcher Parsons, Associate Engineer Randy Tsuda, Assistant Community Development Director PUBLIC HEARING ITEM 1: 14561 Winchester Boulevard Planned Development Application PD-04-6 Requesting to modify an approved Planned Development to allow demolition of an historic house (101 Smith Ranch Court) and to allow a temporary sales office in one of the houses on property zoned RM:5-12:PD. APN 409-20-018. PROPERTY OWNER/APPLICANT: Classics at Vasona Ranch L.P. 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were present: Eddy Wong - neighbor, spoke about concerns with hours of operation, setbacks and security. 5. Public hearing closed. 6. Baily moved to approve the application subject to the conditions presented with the following findings: As required by Section 29.10.09030(c) of the Town Code for the demolition of an historic single family residence, the structure has been found to pose an imminent safety hazard. It has been determined by the Building Official that the residence is a dangerous building pursuant to Section 302.15 of the 1997 Uniform Building Code, and it must be demolished. Substandard floor, wall and roof construction make this structure impossible to retrofit to meet minimum requirements for a safe and habitable residence without complete demolition of the existing floor, walls and roof. For the record, it was stated that the Historic Preservation Committee considered a request for a demolition of the structure when the application for the Planned Development was submitted. An historic structural report was prepared which identified several serious construction deficiencies. It was of the opinion of the consultant that the structure could be saved. Therefore, the Historic Preservation Committee recommended that the house be saved. This application to demolish the structure was not forwarded to the Committee for review since all Town Code requirements to demolish the historic structure have been met in that there has been an order by the Building Official to demolish the structure, and that the Historic Preservation Committee considered the request for a demolition. 7 Parsons seconded, motion passed unanimously. 8 Appeal rights were cited.
