07-06-04 Minutes - DRC TOWN OF LOS GATOS 110 East Main Street, Los Gatos, CA 95032 (408) 354-6872 ----------------------------------------------------------------------------- --------------------------------------------- SUMMARY MINUTES OF A REGULAR MEETING OF THE DEVELOPMENT REVIEW COMMITTEE OF THE TOWN OF LOS GATOS FOR JULY 6, 2004 HELD IN THE TOWN COUNCIL CHAMBERS, CIVIC CENTER, 110 EAST MAIN STREET, LOS GATOS, CALIFORNIA. ----------------------------------------------------------------------------- --------------------------------------------- The meeting was called to order at 9:00 A.M. by Chair Baily. ATTENDANCE Members Present: Sandy Baily, Associate Planner Joel Paulson, Planner Melanie Chase, Fire Department Anthony Ghiossi, Senior Building Inspector Fletcher Parsons, Associate Engineer PUBLIC HEARING ITEM 1: 217 N. Santa Cruz Avenue Architecture and Site Application S-04-051 Requesting approval to modify the front elevation on property zoned C-2. APN 510-17-091 PROPERTY OWNER: The Rugani Family Partnership APPLICANT: Universe LLC 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were not present. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented with the following findings and considerations: 1) The proposed project is categorically exempt, pursuant to Section 15301 of the California Environmental Quality Act as adopted by the Town; and 2) The project is in conformance with the considerations for Arch itecture and Site applications as set forth in Section 29.20.150 of the Zoning Ordinance; and 3) That the work proposed is consistent with the Redevelopment Plan for the Central Los Gatos Redevelopment Project Area (Section IV.B). 7 Ghiossi seconded, motion passed unanimously. 8 Appeal rights were cited. PUBLIC HEARING ITEM 2: 280 Garden Hill Drive Architecture and Site Application S-04-19 Requesting approval to demolish and construct a new single family residence on property zoned R-1:8. APN 424-24-072. PROPERTY OWNER/APPLICANT: Michael and Teri Nevis 1. Chair Baily opened the public hearing. 2. Staff gave report on proposed project. 3. Applicant was introduced 4. Members of the public were present: TJ Pinkham: neighbor expressed concern of privacy in their backyard. Craig Niemeyer: neighbor spoke in favor of project. 5. Public hearing closed. 6. Parsons moved to approve the application subject to the conditions presented and as modified to meet public concerns with the following findings and considerations: 1) As required by Section 29.20.150 of the Town Code for Architecture and Site applications. The considerations required by Sec. 29.20.150 of the Town Code were all made in reviewing this application. 2) As required by Section 29.10.09030(e) of the Town Code for the demolition of a single family residence: a. The Town's housing stock will be maintained in that the house will be replaced. b. The structure has no historic significance. c. The property owner has no desire to maintain the structure. d. The economic utility of the structure is in fair condition. 3) The application is Categorically Exempt from CEQA, Section 15303. 7 Ghiossi seconded, motion passed unanimously. 8 Appeal rights were cited. −3− ITEM 3: 20 S. Santa Cruz Avenue, Suite 200 Conditional Use Permit U-04-021 Requesting approval of a restaurant on property zoned C-2. APN 510-45-076 PROPERTY OWNER: John Feece. APPLICANT: Ed Rathmann Deemed incomplete by Planning Division. Does not need to return to Development Review Committee. Tentatively scheduled for the Planning Commission meeting of July 28, 2004.
