The Town Council of the Town of Los Gatos met in th e
Council Chambers of the Town Hall at 8 :00 p .m ., i n
adjourned regular session .
PRESENT : Ruth Cannon, MarLyn J . Rasmussen, Peter W . Siemens ,
Brent N . Ventura and Thomas J . Ferrito .
ABSENT :None .
Given by all in attendance .
Mayor Ferrito stated this issue had been continued fro m
& K) September 15, 1980, to allow for time to study the agree -
ment . After some discussion it was consensus of Counci l
the agreement should state that it would be to the dis -
cretion of the Park and Forestry Superintendent", t o
decide when it was necessary to water the trees . Mrs .
Cannon moved for adoption of Resolution No . 1980-13 7
entitled, RESOLUTION AUTHORIZING LANDSCAPING AGREEMEN T
WITH SSB & K ASSOCIATES as amended and authorize Mayo r
to execute said agreement on behalf of the Town . Mr .
Siemens seconded . Unanimously carried .
Mrs .Cannon moved for approval of Notice of Completio n
and Certificate of Acceptance for Frank Aries (Alta Vist a
Subdivision 6309 and 6532).Mr . Ventura seconded . Unan-
imously carried .
Mr . Ventura moved that Council retain Hughes, Heiss an d
Associates to act as interim Town Manager as per thei r
proposal submitted to Council . Mr . Siemens seconded .
Carried by vote of three ayes . Mrs . Cannon and Mrs .
Rasmussen voting no, because they felt the other proposa l
presented by Mr . Cooney was more equitable . Mr . Ventur a
then questioned the eligibility of Mrs .Rasmussen votin g
on this issue, as MT .Cooney had worked on Mrs . Rasmussen's
election campaign . Mrs . Rasmussen asked Mr . Hays, Town
Attorney, if it would be permissible for Councilmember s
to change their vote on this issue . Mr . Hays stated, yes .
Mrs . Rasmussen stated she wished her vote be changed t o
aye .
Mayor Ferrito stated this was the time and place dul y
published for public hearing to consider Route 85, Wes t
Valley Corridor Land Use . Planning Director, Lee Bowman ,
spoke on the project and referred to map posted on th e
wall showing the present terminus of Route 85 from Cuper -
tino to Hwy 101 . The State has purchased some of the lan d
and discussion has been held on use of land as transport -
ation corridor rather than a freeway . Lands are in thre e
different zones, the R-1, RM :5-12 and CM Zones . Ther e
are currently 60 dwelling units on land owned by the Stat e
within the right-of-way . Council questioned as to acreag e
of right-of-way . Mr . Bowman stated the State owns approx -
imately'59 acres, that is approximately 85% of right-of -
way within Los Gatos . John D . Michaelsen, 120 Adria n
Place, spoke in favor of retention of 110 feet of Corridor .
Dave Fadness, member of Multi-Modal Task Force, spoke i n
favor of preservation of corridor, and stated this is a
regional matter and needs to show a rational of regiona l
planning . Also, must work hard to get transit in thi s
area and recommends the preservation of 200 ft ., but woul d
settle for 110 ft . Mr . Fadness is to supply the Counci l
with copies of Multi-Modal Task Force studies . Pete r
Giles, President of Manufactures Group, stated they suppor t
strongly, to preserve as much right-of-way as possible .
But,does not know what mode should go in the corridor an d
endorses preservation of 110 ft . Shelly Williams, spok e

TRANSPORTATION the State has received from Gas Tax Funds . He feels fund -
CORRIDOR ing can be done and the Task Force has taken a positio n
(CONTINUED)to preserve 200 ft . as opposed to 110 ft . Robert Bell ,
1513 Bellridge Rd ., San Jose, feels we should preserve a
sufficient width for the corridor and should purchase th e
land as soon as possible, (land is not getting any cheaper).
Ann Ungel, member of Multi Modal Task Force, spoke o n
preservation of 200 ft ., but would be satisfied wit h
110 ft . Other speaking for the preservation of at leas t
110 ft . of the corridor were, Howard Watanabi, Phil Paolo ,
Robert Booth, Ernie Tydell, Betty Maas and Mr . Chaddee .
Mayor Ferrito referred to letter received from Richar d
Gaines, Planning Commissioner, expressing his view tha t
the West Valley Corridor should be preserved for th e
construction of light-rail system with a bikeway adjacen t
to the rail system and recommends that Council place a
moratorium on any further subdivision or further con-
struction on all properties within one quarter mile o n
either side of the Route 85 Corridor . Also, inquired as
to zoning of property on both sides of the corridor .
After further discussion, Council asked for report fro m
Acting Director of Public Works, Mr . Van Houten, as t o
what other cities have done . Mr . Ventura asked for a repor t
from the Town Attorney with regards to-creating a ne w
zone or overlay zone . Or, some sort of zoning tool tha t
would allow for non-permanent uses on all lands withi n
the corridor such as, driving ranges, green houses, so d
farms, etc . Allowing for some reasonable use of the land ,
but without allowing for permanent construction and wit h
a possible time limit on the zoning . Town Attorney t o
advise Council on feasibility of such zoning and how t o
implement it . Council also requested a report from Plan -
ning Director as to the zonings in the corridor and als o
a quarter mile back on either side of the corridor . Afte r
further discussion, Mrs . Rasmussen moved for continuanc e
of the public hearing until October 27, 1980 . Mr . Siemens
seconded . Unanimously carried .
LOS GATOS Mrs . Rasmussen asked staff to investigate building of Lo s
ATHLETIC CLUB Gatos Athletic Club with regards to set backs, etc . S o
ordered .
LCC - LEGISLATIVE Mayor Ferrito appointed MarLyn J . Rasmussen as Town Rep -
COMMITTEE resentative for meeting of League of California Legislativ e
Committee . Meeting to be held October 9, 1980 .
FLOOD CONTROL Mayor Ferrito stated Mr . Van Houten would be the votin g
APPOINTMENTS representative to the Flood Control Board and Mr . Le e
Bowman would be the alternate . Clerk authorized to mai l
necessary forms of designation .
JOINT MEETING Mayor Ferrito reminded Council of a joint meeting of Wes t
WEST VALLEY CITIES 'Valley Cities to consider the report on refuse study .
