M 09-02-198036 9 September 2, 198 0 Los Gatos, Californi a TOWN COUNCIL The Town Council of the Town of Los Gatos met in the Counci l Chambers of the Town Hall at 7 :35 p .m ., in regular session . ROLL CALL PRESENT : Mrs . Ruth Cannon, Mrs . MarLyn J . Rasmussen, Mr . Pete r W . Siemens, Mr . Brent N . Ventura and Mayor Thoma s J . Ferrito . ABSENT :None . PLEDGE O F ALLEGIANCE Given by all in attendance . MINUTES Mayor Ferrito stated on page 5 of the August 7th, 1980 minute s under ANASTASIA'S ATHLETIC CLUB FUND RAISING PROJECT - i t should reflect, "The Council never denied the selling of win e at the Wine Festival, but that the Chamber of Commerce had with - drawn their request for the sale of wine ." Mrs . Rasmussen move d minutes of August 4th, 5th and 7th, 1980 be approved as amended . Mr . Ventura seconded . Unanimously carried . WRITTEN 1 . Letter from Gay Lynn Godfrey (also signed by five othe r COMMUNICATIONS residents), Alpine Chalet, 20 Dittos Lane . Complaining o f illegal aliens residing at the Chalet causing a great dea l of disturbance . Ms . Godfrey, 20071 Old Santa Cruz Hwy , spoke on the complaint stating she had resided at the Chale t until two days ago . She stated she had moved because o f all the problems and she was afraid to stay on after sh e had registered this complaint . Chief Johnson spoke o n Police report submitted by Ms . Godfrey and stated she did no t wish to press charges . Ms . Godfrey stated, she did not pres s charges because she was afraid of what would happen to her . She also spoke of building violations on the premises . Building Official, Archie Watson, stated he was unaware o f said violations . Mary Foster, 20071 Old Santa Cruz Hwy , also spoke on the unruliness of the tenants at 20 Ditto s Lane . Ramona Hamm, 18 Dittos Lane, complained of dirt tha t had been hauled in by the owner of Alpine Chalet . Afte r further discussion, Mr . Ventura moved a letter be written t o Immigration and Naturalization Department asking for an invest - igation of the complaints, also have staff investigate a s to other complaints or violations and report back to determine , if facts are there . If so, the Town could instigate a nui- sance action . Mr . Siemens seconded . Unanimously carried . 2.Letter from Carmel Sandeen, asking why no comfort station s were provided at the new bus shelter at the Town Plaza . Staff to write Ms . Sandeen that comfort stations are locate d at the Lyndon Plaza shopping center across the street . 3.Letter from Wm . F . Fistner, Jr ., stating the prompt actio n taken by Council and staff dealing with the traffic hazar d caused by an improper fence at Camino del Cerro and Los Gatos - Almaden Road is sincerely appreciated by residents of Lo s Gatos Village Association . 4.Letter from Dr . Emil Hopner, 211 Prospect Avenue, thankin g Council for having and supporting an excellent Police Department . 5.Letter from Tod M . Nissen, member of musician group, thankin g Council for their time re a request to play music for loca l people in the downtown area . (Later agenda item). 6.Letter from Sandy Louthian, Chairman of Los Gatos Cultura l Resource Commission, stating the Commission recommends tha t street musicians be allowed to preform on the streets an d outlined regulations . (Later agenda item). 7.Letter from Edward D . Kellar, re rent control ordinanc e receiving a name change, but terms and conditions are th e same . Also stated a non-voluntary arbitration will creat e havoc for the Town and help wrong tenant groups . He requeste d a voluntary arbitration ordinance to help Senior Citizen s only . Ferraro, Director of District #2 , Santa Clara Valley Water District, re the district supportin g the recent passage of AB 1150 . This bill authorizes th e Dept . of Water Resources to approve proposed project for th e inclusion of cisterns in new and existing structures an d requires the Dept . to adopt rules and regulations for admin - istration of the programs . The system has been adopted i n Scotts Valley and thought perhaps Los Gatos might want t o consider such a program . COUNCIL AND Councilman Siemens reported that he had attended the Sanitatio n COMMITTEES District #4 meeting . BID AWARD Mrs . Rasmussen moved to award the bid for compact sedan for us e by the Community Services Agent to West Valley Dodge in the amoun t of $6,366 .62 and approve a supplemental appropriation of $870 .00 from General Fund to cover the additional cost of the vehicle . Jill Cody presented Council with report re mediation progra m implementation alternatives, giving the estimated annual cos t of the three different alternatives . Ms . Cody stated she ha d been handling rent problems under the present mediation progra m and felt it was a success to a point . Lela Austin, Chairperso n for the Community Services & Development Commission, stated th e Commission had some suggestions for funding and costs for a n equitable solution . to the problem of mediation but never consid - ered putting the issue on the ballot,and they request the Tow n to consider other alternatives, such as, the Town underwritin g the first year cost to get the program started . Discussion wa s held on Attorney Hays' report re charging of a fee for th e specific cost of enforcing a regulatory measure . Mary Dean , Director of the Santa Clara Valley Information and Referra l Services, stated they are currently involved in handling tenant - landlord services, up to mediation in some surrounding cities , with whom they have a contract . Mayor stated Mrs . Rasmusse n and Mr . Siemens, as a sub-committee, had worked with Attorne y Hays in establishing the proposed ordinance and guidelines . Mr . Gordon Martin, stated the Renter's Association objected to th e mediation and arbitration ordinance . Mr . E .C . Christenson, o f the Tri-County Apartment Association, spoke on increase of rent s and stated it is due to inflation and questioned if the Counci l has the power to order landlords to arbitrate . Attorney Hay s stated Council does have the power . Mr . Christenson stated , then if that's true, there is no need for the ordinance an d the Tri-County Association opposes the ordinance as it is a rent control ordinance . Mr . Christenson also spoke on th e "Just cause eviction" of tenants . Further discussion was hel d on the proposed ordinance . Mayor Ferrito stated Council woul d review the proposed ordinance step by step and make any changes . Mrs . Rasmussen moved to delete section 24 .30 .15, "Just caus e eviction". Mrs . Jill Cody spoke on letter received from Department of Housin g and Urban Development, stating if referendum is placed on th e ballot the HUD would not reserve the money to fund the project . Mr . Javor, spoke to Council re referendum issue and presente d report from Bion Gregory,Legislative Counsel of California , giving their opinion that an election is not required unde r Article XXXIV . Mr . Schaffran, spoke to Council and requeste d Council to withdraw referendum from the November ballot, as i t is not legally required and would endanger the project bein g financed by HUD . Art Snyder, from audience, stated he though t people should have the right to vote on this issue . Afte r further discussion and comments from the audience, Mr . Rasmussen moved to accept report concerning bike lane s striping through "right turn only" lanes, approve the revise d striping plan and adopt Resolution No . 1980-122 entitled , PARKING RESTRICTION LOS GATOS BOULEVARD . Cannon moved Council accept staff recommendation an d increase the cross walk striping from 12 inches to 24 inche s wide, continue to monitor the operation characteristics of th e intersection and send letter to Ms . No action taken . 376 September 2, 198 0 Los Gatos, Californi a LOS GATOS Robert Bryant, Superintendent of Parks and Forestry, spoke t o STREAMSIDE PARK Council on the proposed bike path, stating he had receive d BIKE PATH information from Caltrans that funding for the proposed' projec t in Los Gatos, as well as other projects throughout the Stat e have been withheld . Mr . Bryant recommends that Council wai t until a final determination has been made on funding prior t o going ahead with a public hearing . Council tabled this matter . Council authorized staff to write Mr . Javor and Mr . Hayde n thanking them for their time and effort re Article XXXIV . PROPOSED YOUTH Mr . Ventura moved that a Youth Advisory Commission be established . ADVISORY A resolution be drafted establishing such a commission an d COMMISSION letters be sent to the schools inviting applicants .
