TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 110 East Main Street, at 7:03 p.m., Friday, June 5, 1992, in special
session.
ROLL CALL
Present: Randy Attaway, Steven Blanton, Brent Ventura
and Chairman Eric D. Carlson.
Absent: Joanne Benjamin

MOBILE HOME PARKS/RENT INCREASES/PASS THROUGH AT TIME OF SALE
ORDINANCE 1906/INTRODUCTION AND ADOPTION (01.16)
Mayor Carlson stated that this was the time and place so noted to consider a report and
discuss regulation of rent increases in mobile home parks and consider possible introduction
and adoption of urgency ordiance preventing pass through of costs.
Town Manager, David Knapp, addressed the current town ordinance and the town's
professional mediation service as these elements relate to pass through of debt service to
renters. These vehicles already offer renters some protection. Council may leave the
ordinance as it is; clarify the language in the existing ordinance; or enact an urgency
ordinance morituorium on all pass through debt.
The following people from the audience addressed this issue:
Debra Grabis, 381 Johnson Ave., owner of a mobile home in the Los Gatos Mobile Home
Park, questioned the method of pass through and how those funds could be used.
Jourden Clish, 14685 Oka Rd., #52, addressed the staff proposals and felt that the second
proposal was preferable, changing his mind to option "C" later in the testimony.
Jack Cole, 14685 Oka Rd., #53, spoke in favor of the urgency ordinance.
Kate Anderton, Town Attorney, addressed the distiction between pass throughs of certain
fees which are limited, and increase in rent based on articulated factors including debt
service.
Melvin Woodall, 484 Woodland Ave, #51, spoke in favor of option "C".

David Laverne, 484 Woodland Ave, #50, is in favor of "C" offering more time to review the
whole issue in context.
Mary Alice Blice, 484 Woodland Ave, #43, does not want to see debt service pass through
affecting rents.
Edward McDonald, 16190 Jacaranda Way, local attorney specializing in mobile home
parks, is in favor of leaving the current ordinance unchanged.
Jerry Mirassou, Bonnie View Mobile Home Park, is in favor of option "A" explaining how
the current ordinance operated during the purchace of the Bonnie View Park.
Jim Wager, 1222 Lincoln Ave., contemplating the purchase of the Los Gatos Mobile Home
Park on a thirty year property management lease basis expressed his opinion regarding the
changes proposed in the current ordinance.
MOBILE HOME PARKS CONT.
Julie Paynschon, 484 Woodland, #9, is in favor of option "C", no pass throughs.
Speaker, 3061 Durma Dr., Santa Cruz, owner of a coach in the park asked questions
concerning the potential new owner's view of park operations.
Jon Chandler, 484 Woodland Ave., #19, is in support of option "C".
Mel Bechler, 484 Woodland Ave., #34, finds it difficult to sell his coach in this park, he is in
favor of option "C".
No one else from the audience addressed the Council.
Motion by Mr. Ventura, seconded by Mr. Attaway, to close the public hearing. Carried by
a vote of 4 ayes. Mrs. Benjamin absent.
Motion by Mr. Ventura, seconded by Mr. Carlson, that Council find that there is an
urgency situation affecting the public peace and safety regarding the homes of numerous
citizens residing in mobile homes in the Town of Los Gatos, and incorporate the items of
reference one through six (1-6) of the ordinance, including severe economic hardship,
injustice, unfair relocation and possible homelessness if mobile home parks are allowed to
be sold without fair and thourough review of ordinances and regulatons. Because of an
immenent threat of sale of mobile home park there is an immediate need to act. Carried by
a vote of 4 ayes. Mrs. Benjamin absent.
Motion by Mr. Ventura, seconded by Mr. Carlson, to waive the reading of the draft
ordinance. Carried by a vote of 4 ayes. Mrs. Benjamin absent. The Town Clerk read the title
of the draft ordinance.
Motion by Mr.Ventura, seconded by Mr. Carlson, that Council introduce and adopt
Urgency Ordinance 1906 entitled, URGENCY ORDINANCE OF THE TOWN OF LOS
GATOS SUSPENDING PROVISIONS OF SECTION 14.89.315 OF THE TOWN CODE
REGARDING RENT INCREASES TO PASS THROUGH INCREASED DEBT SERVICE,
noting that the ordinance is for mobile home parks and the expiration date will be September
5, 1992. Carried by a vote of 4 ayes. Mrs. Benjamin absent.

Mayor Carlson asked that the Rent Advisory Committee take immediate action in discussing
this issue in general for mobile homes and to have a recommendtion back to Council in time
to hear as a full public hearing on all its merits before this urgency ordinance expires
September 5, 1992.

Motion by Mr. Attaway, seconded by Mr. Blanton, that Council adjourn this evening's
meeting at 8:25 p.m. Carried by a vote of 4 ayes. Mrs. Benjamin absent.
