TOWN COUNCIL
The Town Council/Parking Authority of the Town of Los Gatos met in the Council Chambers
of the Town Hall, 110 East Main Street, at 7:43 p.m., Monday, October 5, 1992, in regular
session.

Katherine Anderton, Town Attorney, reported that Council had met in Closed Session prior to
this evening's meeting pursuant to Government Code Section 54956.9(a) to discuss Pending
Litigation and current status of the case regarding Midpeninsula Open Space District v.
Town, et al. and Town v. Pacific Gas & Electric.
Pursuant to Government Code Section 54956.9(b), Council met to discuss Threat of
Litigation regarding Claim of Steven Zavodnick. Status was discussed and possibility of
settling the claim.

COURTSIDE ACCESS ROAD TO COURTSTYLE
Roger Nixon, 222 Palmer, Courtstyle Homeowner's Assoc. representative and,
Russ Aldrich, 109 Palmer Drive, also representing Courtstyle Condominiums, spoke to
willingness to work with neighbors and staff regarding an additional access road for this
development.
David Knapp, Town Manager, is working with and will continue to work on this issue with
the Courtstyle representatives.

HISTORIC PRESERVATION/DISTRICT OVERLAY ZONES/HEARING (17.46)
ZONING ORDINANCE AMENDMENT A-92-6/HEARING (18.46)
INTRODUCTION OF ORDINANCES
Vice Mayor Benjamin stated that this was the time and place duly noted for public hearing
to consider amendments to the Town's Historic District overlay zones concerning the Almond
Grove Historic District (HD-80-1A), Broadway Historic District (HD-84-2A), Fairview Plaza Historic
District (HD-76-1A) and the University/Edelen Historic District (HD-86-1B) (relating to
development standards and when review is required by the Historic Preservation Committee) and
consideration of boundary changes to the Fairview Plaza Historic District, including hearing to
consider amendments to the Town Code to revise the duties of the Historic Preservation
Committee. Applicant: Town of Los Gatos.
The following people from the audience spoke to these issues:
Leslie Dill, 220 Wilder Ave., Historic Preservation Committee representative, gave
background on the Committee's work on this Ordinance.
Olivia Davies, Almendra, feels that funds should be spent on preserving the historic
concrete streets in these districts, and that if this is not done due to expense it will allow the
argument that private preservation of historic elements could consider the use of the cheaper
non-historic materials in the upkeep and renovation of their homes in the districts due to
finances. She feels that preservation of the concrete streets should not be abandoned.
Robert Murphy, 72 Fairview Plaza, is concerned with homes that are not historic, but are
located in the Historic Districts. He was informed that if he needed to rebuild his home due
to a catastrophe, it could be rebuilt according to it's former style and not that of the district's.
He pointed out that the ordinance does not mention that non-contributing structures are free
to remodel/build according to the owner's option, but must copy the original structures style.
Steve Lucero, 133 Lynhurst Crt., representing the Los Gatos-Saratoga Board of Realtors,
stated Board is in favor of the core of the ordinance but questions the use of the words

"strongly suggest" in the use of materials and the need to include portions of the home not
viewed from the street.
Bonnie Wilson, 1188 Hyde Ave., representing the Los Gatos-Saratoga Board of Realtors,
is in favor of maintaining the integrity of the district but feels that the portion regarding the
rear of the house is too restrictive. Mentioned that the Board is running a training session for
members regarding the Historic Districts.

Nikki Clapp, 108 Cherry Hill Court, member of the Historic Preservation Committee, spoke
of the work that the Committee had done, and felt as a real estate broker herself that the
ordinance helped uphold the integrity of the districts.

a vote of 4 ayes. Mayor Carlson absent.
Motion by Mr. Blanton, seconded by Mr. Attaway, to revise the wording of the draft
ordinance to read with more encouragement and less strong recommendation or
discouragement. Mr. Attaway withdrew his second after some discussion. Motion failed due
to lack of second.
Motion by Mr. Blanton, seconded by Mr. Attaway, to change the words "strongly
recommends" throughout the ordinance to "recommends" throughout the document.

Motion by Mr. Attaway, seconded by Mr. Blanton, under the building materials section
the following should be added. In hardship cases an alternative material can be reviewed
and approved by the deciding body. Carried by a vote of 4 ayes. Mayor Carlson absent.
Motion by Mr. Attaway, seconded by Mr. Ventura, under Item 10, page 15, Colors For
Victorians, the traditional three or four color patterns are encouraged. The word "strongly"
shall be struck from this section. Carried by a vote of 4 ayes. Mayor Carlson absent.
Motion by Mr. Attaway, seconded by Mr. Blanton, under Item 3, subsection "b", page 17,
add a section stating that reference material can be used to document a period or style.

Motion by Mr. Blanton, seconded by Mr. Attaway, that Council introduce Draft Ordinance
entitled, ORDINANCE OF THE TOWN OF LOS GATOS AMENDING DIVISION 4,
SECTION 2.30.605 THROUGH 2.30.620 RELATING TO CONFLICT OF INTEREST CODE.

Motion by Mr. Blanton, seconded by Mr. Attaway, that Council approve policy having
Town contracts with consultants contain a statement regarding the need for financial
disclosure. Carried by a vote of 4 ayes. Mayor Carlson absent.
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council authorize transfer of
$500.00 for copy and mailing costs from unrestricted reserves to the Town Clerk's budget
account 1056-60510 with the stipulation that the Clerk's Office will write a letter to the FPPC
requesting the additional forms needed for this procedure and that the finance department
will bill the State or FPPC when they inform the Town that the Town has to print its own

MINUTES OF SEPTEMBER 21, 1992 (22.V)
Mr. Blanton requested a review of item 22, page 8, concerning the motion regarding the
bus layover move from the Civic Center to South Santa Cruz.

The following person addressed Council on this issue:
Mark Portman, 18000 Idylwild Road, requested Council use the medical expert who's
resume is before them this evening.
Richard Craig, representing GTE Mobilnet, 4410 Rosewood Drive, Pleasanton, requested
that the expert chosen by ESA be used since he is available at this time and the process can
be moved along in a more timely manner.

as specified in Resolution 1992-180 using Dr. Jerrod Bushberg as the medical expert.

MOBILE HOME/RENT INCREASES/TOWN CODE AMENDMENTS (25.16)
RENTAL DISPUTE MEDIATION AND ARBITRATION ORDINANCE
Katherine Anderton, Town Attorney, mentioned several typographical errors that needed
correction in the draft ordinance and which were enumerated in the addendum to the staff
report.
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council waive the reading of the
Draft Ordinance. Carried by a vote of 4 ayes. Mayor Carlson absent. The Town Clerk
read the Title of the Draft Ordinance.

EXCLUDE NON-PARK OWNED MOBILE HOMES. Carried by a vote of 2 ayes. Mr.
Ventura voted no, stating that he feels that the proposed basic rent increase each year is
inequitable. Mrs. Benjamin abstained due to previous absence. Mayor Carlson absent.
NUISANCE ABATEMENT/ORDINANCE INTRODUCTION (26.46)
Vice Mayor Benjamin stated that this was the time and place duly noted to consider nuisance
abatement.
Motion by Mr. Attaway, seconded by Mr. Blanton, that Council hold the draft Nuisance
Abatement Ordinance for six months until development of the FY 93-94 Operating Budget to
determine if funding is available to hire staff to process nuisance complaints. Carried by a
vote of 3 ayes. Mr. Ventura voted no stating that he has previously told constituents he

would do all he could to get this item adopted. Mayor Carlson absent.
BACHMAN PARK/PLAYGROUND EQUIPMENT/INSTALLATION (27.25)
Vice Mayor Benjamin stated that this was the time and place duly noted to consider
installation of playground equipment at Bachman Park.

Elaine Cardinale, 235 Belmont Ave., spoke in approval of the neighborhood meeting
regarding the playground equipment at the park.
There were no other speakers from the audience to address this issue.
Council accepted report as submitted.
MEETING SCHEDULE/TOWN COUNCIL (28.10)
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council approve the revised 1992-
93 Town Council Meeting Schedule by deleting the proposed October 20th meeting for a
Study Session regarding Traffic Impact Mitigation Fees and incorporating that Study Session
with the Community Services to be held on October 26, 1992. Traffic Mitigation will begin at
6 p.m. and Community Services will commence at 7:30 p.m. Carried by a vote of 3 ayes.
Mr. Ventura abstained. Mayor Carlson absent.
ADJOURNMENT
Motion by Mr. Blanton, seconded by Mr. Attaway, that Council adjourn this evening's
meeting (at 9:56 p.m.) to Closed Session immediately following the Redevelopment Agency
meeting. Carried by a vote of 4 ayes. Mayor Carlson absent.
