TOWN COUNCIL
The Town Council of the Town of Los Gatos met in the Council Chambers of the Town
Hall at 7:45 p.m., in an adjourned session.
ROLL CALL
PRESENT: Ruth Cannon, Thomas J. Ferrito, Marlyn J. Rasmussen, Brent N. Ventura
and Mayor Peter W. Siemens.
ABSENT; none
REPORT RE EXECUTIVE SESSION
Mayor Siemens reported on the Executive Session that was held prior to the Council
meeting, stating the following matters were discussed:
1. Litigation re State State Supreme Court level on Election consolidation, and
authorized the Town Attorney to proceed, only if Supreme Court holds a hearing.
2. Town of Los Gatos joining with San Mateo in litigation re loss of representation in
recent reapportionments. (No cost to the Town).
3. Litigation relative to possible zoning violations.
4. Litigation of Los Gatos Mobile Home Park in relation to Rent Mediation Ordinance.
Authorized the Town Attorney to proceed on this matter.
Voting on the above were unanimous by Council except for No. 3 which Mr. Ventura
voted no.
TANDEM COMPUTERS-COUNTY REFERRAL
Mr. Kurt Anslinger reported to Council on the action of the Board of Supervisors re the
proposed building of an Educational Retreat (Tandem Computer), on Black Road. He
stated at the hearing that the Board seemed to feel Los Gatos was not interested and
he would like to urge or request Los Gatos to file an appeal. After some discussion, it
was consensus of Council that they advise Mr. Anslinger to file an appeal requesting
that a focused EIR be prepared and Town will direct staff to send a letter to the Board of
Supervisors stating strongly the Town's position. Council also requested a report from
staff on this issue by February 16, 1982.
REVISED JOB DESCRIPTIONS PARKS & PUBLIC WORKS MAINTENANCE
EMPLOYEES
The Town Manager, Dave Mora, stated the new job descriptions have been developed
for the Town by the Santa Clara Employee Relations Services and this is a result of an
item in the Memorandum of Understanding between the Town and AFSCME which
mandated that a classification study be undertaken. Mrs. Cannon moved for adoption
of Resolution No. 1982-43 entitled, A RESOLUTION OF THE COUNCIL OF THE
TOWN OF LOS GATOS APPROVING AMENDMENTS TO THE TOWN'S
CLASSIFICATION PLAN. Mr. Ventura seconded. Unanimously carried.
AMENDING SALARY & POSITION CONTROL
The Town Manager stated this Resolution deals with the implementation of the
classification study for employees represented by the Corporation Yard Unit, AFSCME.
After some discussion, Mrs. Cannon moved for adoption of Resolution No. 1982-44
entitled, AMENDMENTS TO SALARY SCHEDULE RESOLUTION NO. 1981-44 TO BE
EFFECTIVE SEPTEMBER 1, 1981. Mrs. Rasmussen seconded. Unanimously carried.
MID-YEAR BUDGET REPORT
The Town Manager referred to the report on the Mid-Year Budget re status of various
funds and various departmental budgets as of December 31, 1981. After some
discussion, Mr. Ventura moved Council accept staff recommendation and take the
following actions:
1. Revise Town revenue estimates for the current fiscal year as detailed in the Mid-
Year revenue Analysis (Page 4 of this report).
2. Appropriate $203,000, in additional revenue to the current year appropriated General
Fund contingency.
3. Make supplemental appropriations from current year General Fund appropriations
contingency to the following budget:
Town Attorney $17,000.00
General Town Administration: $25,000.00
Villa Vasona Litigation
General Town Administration: $3,300.00
Salaries/Benefits (Mid-year Performance increases for Department Heads)
Planning Department $2,715.00
TOTAL $48,015.00
4. Establish a reserve account in the amount of $125,000 to fund the Town's potential
liability for employee contributions to the Town Pension Plan; funds would be
transferred from the appropriated unallocated reserve.
5. Transfer an additional $500,000, from appropriated unallocated reserve to the
reserve for Economic Uncertainties, providing a reserve equal to approximately one-
third of the General Fund budget.
6. Establish a $250,000 reserve for acquisition and/or construction of a bus station site;
funds will be transferred from appropriated unallocated reserve.
7. Direct staff to prepare alternative amendments to the Construction Tax Ordinance.
8. Reserve the appropriation made in July 1980 of $280,000, of Construction Tax to
undersigned utility undergrounding projects; the appropriation was never designated for
a specific project, and the funds have not been used.
9. Authorize a loan from the Utility Tax portion of the Construction Tax to be paid back
as revenue if generated.
Mrs. Cannon seconded. Unanimously carried on all but No. 3. Mrs. Rasmussen voted
no on No. 3 re supplemental appropriation for Town Attorney's budget of $17,000.
CALL FOR ELECTION ON ADVISORY MEASURE FOR JUNE, 1982
Mr. Ferrito moved for adoption of Resolution No. 1982-45 entitled, A RESOLUTION
CALLING ADVISORY ELECTION IN CONSOLIDATION WITH THE REGULAR
ELECTION OF JUNE 8, 1982, FOR THE PURPOSE OF ALLOWING THE VOTERS TO
INDICATE TO THE TOWN COUNCIL WHETHER THEY DESIRE COUNCIL
ELECTIONS TO BE CONSOLIDATED WITH NOVEMBER ELECTIONS IN ODD OR
EVEN YEARS. Mr. Ventura seconded. Mrs. Rasmussen asked for discussion of
possibility of rescinding previous Ordinance and only extend terms to June, 1982
election and also include the advisory measure. No discussion. Motion carried by vote
of three ayes. Mrs. Cannon and Mrs. Rasmussen voting no.
ADJOURNMENT
Mayor Siemens declared meeting adjourned at 9:15 p.m. to executive session. Mayor
declared he would report re executive session at the beginning of the next regular
Council meeting.
