M 07-26-82TOWN COUNCIL MEETING JULY 26, 1982 TOWN COUNCIL The Town Council of the Town of Los Gatos met in the Council Chambers of the Town Hall at 7:45 p.m., in continued regular session. ROLL CALL PRESENT: Thomas J. Ferrito, Marlyn J. Rasmussen, Peter W. Siemens and Mayor Brent N. Ventura. ABSENT: Ruth Cannon. PLEDGE OF ALLEGIANCE Given by all in attendance. REPORT ON EXECUTIVE SESSION Mayor Ventura stated the Council had met in closed session prior to the Council meeting and discussed personnel matters. No action was taken. ZONE CHANGE TO IMPLEMENT DOWNTOWN SPECIFIC PLAN Mayor Ventura stated this was the time and place duly published for public hearing to consider Planning Commission recommendation on zoning ordinance amendments A- 82-2 and A-82-3 and also zone change application Z-82-3. The Town Manager, Mr. Mora, stated the change in zone change for approximately 1,000 parcels of land located within the downtown area is to bring the zone in conformance with the recently adopted Downtown Specific Plan. Planning Assistant, Donald Ross, explained the various changes in the zoning ordinance that Planning had considered. Mayor Ventura declared the public hearing open. Mr. Wade Hover, Attorney representing several property owners, stated any proposal before Council tonight has never been considered by any Citizen Advisory Committee. All proposals that Council has is what has been modified, changed, amended and passed back and forth through hearing procedures over a long period of time. What is before Council tonight is not a complete, final, discussed concerned plan that has been looked at from a citizens point of view and Mr. Hover feels most people are against the proposals as presented. J.B. James, owner of property at the NW. corner of Monterey and Andrews Street spoke in opposition of rezoning os his property to R-1D. Gregory Delaney spoke on the issue. John Heindel, 646 N. Santa Cruz Avenue spoke against rezoning and asked what is motivation and reason for said rezoning. Don Ross stated the Citizen Advisory Commission had made recommendations. Sally Simon, 128 University Avenue, questioned if the building was destroyed, could it be rebuilt? This question was asked by several people and answer was yes, on the same foundation. Marianne Groh, 129 Edelen Avenue, spoke against the growth of the Town Service Center at the end of Miles Avenue, stating the noise and traffic of heavy trucks was terrible and she opposes any changes to rezoning. S. Richardson spoke in opposition to rezoning, stating this would downgrade the property and lower the value. Philip Vlamis and Red Halunen also spoke against the rezoning. William Meyer and Rollin Cussman spoke against rezoning of property at 92 Saratoga Avenue. Mr. Cushman stated he has been working towards possible building of senior citizen units with the possible offices below on this property. Allen Reames, Bernice Dwyer and Jamil Modir all spoke in opposition to any rezoning. Fred Boitano, spoke against the rezoning of 437 University Avenue and questioned if the building burned, would he be allowed to rebuild. The answer was yes, on the same foundation. He also asked for a written legal opinion. The foundation is wooden and that would burn also. It was consensus of Council to have the Town Attorney to give a written opinion to Council at the next regular meeting and copy of this opinion to be sent to Mr. Boitano. Others speaking against the rezoning in the downtown area were Gus Mariotti, M. Pasero and Bobbie Crafford. RECESS Mayor Ventura declared a recess. Meeting reconvened at 10:14 P.M. Grace Hooten, 242 Los Gatos Boulevard, spoke in opposition of the down grading of her property and requested the zoning remain as is. Patrick Grey, 25 Montgomery, spoke against rezoning and requested that Council allow himself and Mr. Della Maggiore to proceed with a development jointly under the existing zoning. Mr. Ferrito asked for staff report relative to Planning Commission's policy on two unit condominiums. Wade Hover, Attorney representing the Zanardi property at 663 through 675 N. Santa Cruz Avenue, opposed the rezoning of the properties and could see no substantial reason for any change. J. Stanger, 354 Bachman Avenue requested zoning on his property remain the same. This would give him the opportunity to keep his property in it's natural state. Also speaking against any rezoning of their property were Mrs. Zucconi, M. Gerhardt, Beatrice Ditman, Zona Boyer, Lillian Nerenberg, Patricia Blackley and Don Townsend. No one else wished to speak on this issue. Mr. Ferrito moved hearing be closed. Mr. Siemens seconded. Unanimously carried. After further discussion, it was consensus of Council no action be taken at this time. Mr. Ferrito moved Council take this under consideration and be placed on the agenda for August 2, 1982. Mr. Siemens seconded. Unanimously carried. ADJOURNMENT Mayor Ventura declared the meeting adjourned at 11;15 P.M.
