Dear Mayor Sayoc:
In a meeting with your staff last week, Habitat staff members were informed the Council might be reconsidering the
plan to work with us to develop ownership affordable housing on the property known as 20 Dittos Lane in Los Gatos.
Yesterday in the memo issued by your staff, this information was confirmed. We are very disheartened by this turn of
the events, as Habitat has invested enormous time, resources and funds to prepare a feasible development proposal
and establish Habitat readiness for neighborhood meetings.
Town of Los Gatos surplus the property on March 19, 2016. Habitat staff expressed interest to work with Town of Los
Gatos to develop this property. Below is a highlight of major milestones that have taken place on the property:
• November 7, 2016—Town of Los Gatos issued request for proposal (RFP) for development of the property.
• January 13, 2017 — Habitat issued a letter of response to the RFP with supporting documents and formally
expressed its desire to develop the property for affordable homeownership (Please see attached).
• April 11, 2017 — Habitat was informed the Town Council, during a Closed Session meeting, decided
unanimously to negotiate with Habitat for Humanity for the donation of the property to construct affordable
homes, which would meet the original intent of the Redevelopment Agency's purchase of the property
(Please see attached). It was Habitat's understanding that the RFP was now closed.
• April thru August — Habitat held numerous meetings with Town staff as well as the two immediate neighbors
and the Santa Clara County Fire Department. Through various planning and proposals, Habitat created a
feasible development proposal for development of affordable homes on the property.
• June 27, 2017 — Habitat's Board of Directors reviewed and approved the proposed development and
authorized staff to further the design of the development and start the negotiation of the DDA.
• July 19, 2017 — Santa Clara County officials confirmed their interest in funding Habitat and the project.
• During the past six months, Habitat has engaged architects and engineers to further the proposal and now
Habitat is preparing to conduct neighborhood meetings to examine the proposal with all immediate
neighbors and interested town residents.
During all of this time, Habitat staff has not once received feedback that Town staff and/or Council members were
displeased with our progress. Therefore, it is baffling as to why the Council would now decide to pursue other
interested parties. Habitat has worked in partnership with Los Gatos in good faith. We encourage the Council to
honor your decision to negotiate with Habitat regarding the donation of this property as previously agreed. Please do
not continue with the RFP and direct staff to start the negotiation of DDA with Habitat.

Dear Hamid: Thank you for your phone call yesterday to discuss your organization's continued efforts to
communicate with the adjoining property owners of the Dittos Lane parcel. During the call, you asked that I
confirm the action that the Town Council took in early February during Closed Session regarding the Dittos
Lane vacant parcel. As you recall, the Town issued an RFP for purchase of the property which had been
acquired previously by the Los Gatos Redevelopment Agency for development of below market rate housing.
The Redevelopment Agency was unsuccessful in its attempts to develop the project in partnership with a
private developer. The Town received two proposals in response to the RFP: one for development of market
rate housing and the other from Habitat for Humanity for development of below market rate single family
homes. The Council was unanimous in its decision to negotiate the donation of the property to Habitat for
Humanity to construct single family homes, which would meet the original intent of the Agency's purchase of
the property.
We appreciate Habitat's continued interest in the property and are aware that you and your staff have had
discussions with the adjoining property owners to receive their input and further, that you and your staff
have initiated due diligence efforts required for permitting approvals to construct the single family homes.
The Council remains interested in donating the property to Habitat for Humanity. We will stay in contact with
you to determine when a formal agreement can be brought to Council at an open meeting.
