Attachment 2MEMORANDUM Police Department 4gPivA*base oss4 e TO: LAUREL PREVETTI, TOWN MANAGER MAYOR REVIEW (cr/21/19 FROM: MICHAEL D'ANTONIO, INTERIM CHIEF OF POLICE SUBJECT: TOWN MANAGER AUTHORITY THIRD AMENDMENT TO AGREEMENT FOR SCHOOL RESOURCE OFFICER SERVICES DATE: JUNE 20, 2017 RECOMMENDATION: It is recommended that the Town Manager execute a Third Amendment to an Agreement for School Resource Officer services dated July 1, 2011 with the Los Gatos -Saratoga Union High School District and the Los Gatos Union School District for a two-year period of July 1, 2017 through June 30, 2019. BACKGROUND: Beginning prior to 2011, the Town of Los Gatos (Town), Los Gatos Union School District (LGUHSD), and the Los Gatos -Saratoga Union High School District (LGSUHSD) have participated in a cost sharing agreement for the service of one FTE police officer assigned as a School Resource Officer (SRO). In FY 2011/12, the Town entered into a two-year agreement with LGUHSD and LGSUHSD, to which there have been two subsequent Amendments, each also for a two-year period. Past practice was there were no formal staff reports or Resolution associated with the agreements and amendments, rather, the funds have been associated with the adoption of the Town's annual Operating Budget. The amount funded by the school districts is approximately 50% of the salary and benefits for the SRO position. Main Street Los Gatos, CA 95030 • 408-354-6832 www.loseatosca gov PAGE 2 OF 2 DATE: JUNE 20, 2017 SUBJECT: TOWN MANAGER AUTHORITY THIRD AMENDMENT TO AGREEMENT FOR SCHOOL RESOURCE OFFICER SERVICES While the annual adopted Operating Budget does include funding for the SRO position, under the current Town Procurement Policy the agreement amounts exceed the Town Manager's contract approval authority of $50,000. Additionally, the Operating Budget is adopted for a single Fiscal Year. Therefore, staff wishes to formalize the agreement in line with information contained in the Adopted Operating Budget, and seeks Council approval of a Third Amendment for a two-year period. Additionally, at the term end of the Third Amendment (FY 2018/19), the Town will bring forward a new Agreement for Council discussion and approval, and inclusion in the annual proposed Operating Budget. CONCLUSION: To ensure continuous partnership with LGUHSD and LGUHSD, staff recommends that the Town Manager execute a Third Amendment to the Agreement for School Resource Officer services for a two-year period of July 1, 2017 through June 30, 2019 (FY 2018/19.) FISCAL IMPACT: There are sufficient funds available for this agreement through the Town's Adopted Operating Budget for fiscal year 2017/18, utilizing Police Department program 4303. The referenced parties agree to provide funding for the School Resource Officer on an annual basis to cover expenses including salary and benefits. All parties shall contribute toward the total overall cost of the School Resource Officer as follows, and as is demonstrated in the Agreement: FY 2017/18 FY 2018/19 • Los Gatos Union High School District: $84,953 (36%) $86,853 (36%) • LG-Saratoga Union High School District: $33,037 (14%) $33,776 (14%) • Town of Los Gatos: $117,991 (50%) $120,630 (50%)
