PROJECT LOCATION: 106 E. MAIN STREET. APPLICANT: MEHDI DALVAND, THE MIDGLEN STUDIO. PROPERTY OWNER: TOWN OF LOS GATOS. CONSIDER A REQUEST TO CONSTRUCT A CANOPY OVER AN EXISTING PATIO ON A PROPERTY ZONED C-1:PD. APN 529-34-108. RECOMMENDATION: Adopt a Resolution (Attachment 3) approving a request to construct a canopy over an existing patio. BACKGROUND: On July 1, 2013, the Town of Los Gatos entered into a lease agreement with the Los Gatos Museum Association (NUMU) for the re-use of the former library facility located at 106 E. Main Street. On February 3, 2015, the Town Council adopted Resolution 2015-004 (Attachment 2) approving Conditional Use Permit (CUP) application U-13-017, permitting operation of a museum and related activities. Following structural and tenant improvements to the facilities, NUMU celebrated its grand opening on May 28, 2015. At its December 1, 2015 meeting, Town Council approved NUMU’s first proposal for signage facing the interior deck area of the Civic Center. An additional street-facing wall sign located on the wing wall adjacent to the north entrance was approved by Town Council on September 8, 2016. PAGE 2 OF 3 SUBJECT: 106 E. MAIN STREET/S-17-013 JUNE 1, 2017 S:\COUNCIL REPORTS\2017\06-06-17\14 - NUMU Awning\Staff Report Final.docx 6/1/2017 4:15 PM DISCUSSION: The applicant has submitted an Architecture and Site application on behalf of NUMU to construct a new 600-square foot canopy over the existing patio adjacent to the entrance on the north side of the building at 106 E. Main Street. The main entrance is located on the south side of the building off the Civic Center deck area. The applicant submitted development plans on April 27, 2017 (Attachment 3, Exhibit B). The frame of the proposed canopy would be constructed with tube steel roof trusses , powder- coated to match the concrete features of the building. The trusses would b e secured to the existing concrete fascia above the north entrance of the building. Vertical supports, consisting of three sets of grey powder-coated double tube steel posts, would be secured to the existing concrete pilasters that project above the existing wall on the north side of the patio. The canopy’s frame would be covered with a polyester base cloth in grey to match the concrete features of the building. The steel-trussed roof would be pitched to facilitate drainage away from the building. A 17-inch tall valance concealing the pitched roof would wrap around the edges of the canopy, visually continuing the existing concrete band at the top of the building. The proposed frame and polyester roof and valance would be compatible with the existing materials (concrete, brick, wood, die-cut aluminum signs, and galvanized steel) on the building, contributing a cohesive design. The canopy would cover an existing patio and create an outdoor space for the museum to use . As proposed, the canopy would be consistent with the development regulations of the Planned Development zoning of the property, the Conditional Use Permit (U-13-017), and the lease agreement. CONCLUSION: It is recommended that the Town Council adopt a Resolution approving the request for installation of a canopy over the existing patio, subject to the conditions of approval included in Attachment 3 (Exhibit A) and the development plans included as Exhibit B. ALTERNATIVES: Alternatively, the Council may: 1. Adopt a Resolution to approve the application with modified or additional conditions of approval (Attachment 3, Exhibit A); or 2. Adopt a Resolution to deny the Architecture and Site application (Attachment 4). PAGE 3 OF 3 SUBJECT: 106 E. FISCAL IMPACT: If the application is approved, NUMU would be responsible for all costs associated with the permitting, fabrication, installation, and maintenance of the canopy. In the event that the lease with NUMU were discontinued, NUMU would be responsible for removal of the canopy and remediation of the existing building, to the satisfaction of the Town Manager pursuant to the existing lease agreement. ENVIRONMENTAL ASSESSMENT: The project is Categorically Exempt pursuant to the adopted Guidelines for the Implementation of California Environmental Quality Act, Section 15303: New Construction or Conversion of Small Structures.
