Ord 1535-AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 57 FROM RM:5-12-LPH-LPH TO RM:5-12-LPH-PD�r ORDINANCE NO. 1535 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 57 FROM RM:5 -12 -LHP -LHP TO RM:5- 12- LHP -PD SECTION I The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property at the westerly terminus of Bean Avenue shown on the map which is attached hereto, marked Exhibit A and is a part of this ordinance, from RM:5- 12- LHP -LHP (Multiple Family Residential, 5 -12 units per net acre - Landmark and Historic District - Landmark and Historic District) to RM:5 -12- LHP -PD (Multiple Family Residential, 5 -12 units per net acre - Landmark and Historic District - Planned Development). SECTION II The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. Eight (8) new 2 -story dwelling units, for eventual sale as planned development units (as defined in the Business and Professions Code Section 11003). 2. Preservation and rehabilitation of an existing historically designated brick building. 3. Parking for the residential condominium units at a ratio of 3 spaces per unit minimum. 4. Landscaping, parking, and other improvements shown and required on the Official Development Plan. 5. Uses permitted are those specified in the RM:5 -12 (Multiple Family Residential) zone by Sections 4.30.020 (Permitted Uses) and 4.30.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in Section 4.30.030 is allowed unless specifically authorized by this ordinance, or by conditional use permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION IV Architecture and Site Approval is required before any grading or construction work is performed, whether or not a permit is required for the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A (Zone Change Vicinity Map), the attached Exhibit B (Preliminary Development Plan), Exhibits C -G (Unit Floor Plans), H and I (Architectural Elevations), J (Conversion of Existing Building), K (Landscape Plan), L (Typical Section), M (Aerial Photo), N and 0 (Building and Tree Shadow Plan) are part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: 1. The applicant shall acquire and dedicate the following rights -of -way, to the satisfaction of the Town Engineer: a. Bean Avenue to provide for the installation of the additional improvements, including a 24- foot -wide roadway and a 5- foot -wide sidewalk. b. Public utility, storm drainage and sanitary sewer easements as required. 2. The applicant shall guarantee, by contract and bonds, the following improvements, to the satisfaction of the Town Engineer: a. Bean Avenue (south side) to provide a 24- foot -wide curb -to -curb travelled way, including curb, gutter, 5- foot -wide sidewalk, tie -in paving, 10 -foot radius curb returns at Massol, and storm drain facilities as required. b. On -site improvements including a 22- foot -wide roadway, curb, gutter, 4- foot -wide sidewalk along one side, paving, lighting, storm drainage and sanitary sewer facilities. 3. The applicant shall investigate the possibility of entering into a joint project with the adjacent property owners to install the Bean Avenue street improvements. If the adjacent property owners do not desire to participate, the applicant shall be responsible for installing the improvements. 4. The applicant shall provide final grading, drainage, lighting and traffic circulation plans, to the satisfaction of the Town Engineer. -2- 5. No gates shall be installed across the Bean Avenue access driveway. 6. Prior to any building permits being issued, the applicant shall meet with the Superintendent of Parks and Forestry concerning the need for protective fencing around existing trees. A plan for such protective fencing demonstrating type and location shall be submitted to the Planning Director after being approved by the Superintendent of Parks and Forestry. Such fencing is to be installed prior to issuance of the building permits and be maintained during construction. Also included in the plan shall be the location of any existing trees to be removed. 7. Four additional on -site parking spaces be provided to provide for two guest parking spaces per unit, and that these visitor spaces be broken up into groups of four. 8. Building modifications required in the precise development plans shall include provisions for active solar and reducing the peak of the roof line by four feet. SECTION VI This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation and circulated in the Town. This ordinance was introduced at a continued regular meeting of the Town Council of the Town of Los Gatos on Auril 20th , 1982, and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on May 3rd , 1982.
