Ord 1514-AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 53 FROM R-1:8 TO R-1:8-PDORDINANCE NO. 1514 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 53 FROM R -1:8 TO R- 1:8 -PD SECTION I The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning on property addressed as 15755 Blossom Hill Road shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from R -1:8 (Single Family Residential, 8,000 square foot lot size minimum) to R- 1:8 -PD (Single Family Residential, 8,000 square foot lot size minimum - Planned Development). SECTION II The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. Demolition of an existing single family residence fronting on Blossom Hill Road. 2. Construction of six (6) two -story residential townhouse units. 3. Retention of a single family residence fronting on Camino del Cerro. 4. Landscaping, parking and other improvements shown and required on the Official Development Plan. 5. Uses permitted are those specified in the R -1 (Single Family Residential) zone by Section 4.26.020 (Permitted Uses) and 4.26.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in Section 4.26.030 is allowed unless specifically authorized by this ordinance, or by Conditional Use Permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION VI Architecture and Site Approval is required before any grading or construction work is performed, whether or not a permit is required for the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A, (Zone Change Map) the attached Exhibit B (Proposed Site and Landscape Plan), Exhibit C and D (Unit Floor Plans) and Exhibits E, F, G, (Exterior Elevations) are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: 1. The applicant shall dedicate right -of -way and utility easements, to the satisfaction of the Town Engineer, to provide: a. A 42 -foot half- street along the Blossom Hill frontage. b. A 10- foot -wide storm drain easement to carry on -site drainage to the existing storm drain in Camino del Cerro. 2. Guarantee, by contract and bond, the following improvements, to the satisfaction of the Town Engineer: a. Blossom Hill Road frontage, including curb, gutter, sidewalk, pavement, street light, sound wall, and masonry retaining walls as required. b. Camino del Cerro frontage, including concrete driveway approach and street light. c. Entrance driveway and interior light, including curb, gutter, sidewalk (one side), pavement, street lights, storm and sanitary sewers. d. Storm and sanitary sewers as required. 3. Provide grading, drainage, street lighting, circulation and erosion control plans, to the satisfaction of the Town Engineer. 4. The applicant shall underground the existing overhead electrical and telephone services to the existing residence on Camino del Cerro. 5. Solar hot water heating systems shall be provided for each unit. 6. The final choice of exterior siding material shall be determined at the time of Architectural and Site Approval. 7. The two units on the westerly side of the project shall be joined to- gether with a common wall rather than detached as shown on Exhibit B. 8. "NO PARKING" signs and /or other appropriate notices prohibiting obstruc- tions of the driveway areas shall be required and shall be maintained to - 2 - the satisfaction of the Fire Department. 9. Gates shall not be installed across the driveway entrance. 10. Prior to any building permits being issued, the applicant shall meet with the Superintendent of Parks and Forestry concerning the need for protective fencing around existing trees. A plan for such protective fencing demonstrating type and location shall be submitted to the Planning Director after being approved by the Superintendent of Parks and Forestry. Such fencing is to be installed prior to issuance of the building permits and be maintained during construction. 11. Height of all buildings is limited to 24' above average grade to the peak of the roof. 12. Addition of a sound barrier and landscaping along South property line adjacent to access drive shall be considered at the time of Architecture and Site review. SECTION VI This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on September 8th , 19 81 , and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on September 21st , 1981 AYES: COUNCIL MEMBERS Ruth Cannon, Thomas J.
