RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
TO SET A DATE FOR CONSIDERATION OF A REORGANIZATION
OF AN UNINHABITED TERRITORY DESIGNATED
SHANNON ROAD NO. 27

PROPERTY OWNER/APPLICANT: RAY M. ELAM
WHEREAS, the Town Council of the Town of Los Gatos has received a request for
annexation of territory designated Shannon Road No. 27 from Ray M. Elam; and
WHEREAS, the property, 28.61 acres located at 14915 Shannon Road, APN: 537-27-047,
is contiguous to the Town of Los Gatos and within the Town's Urban Service Area; and
WHEREAS, the following special district would be affected by the proposal: Santa Clara
County Library Service Area; and
WHEREAS, the annexation would provide for use of Town services; and
WHEREAS, the Town Council adopted Ordinance 1494 in 1981 zoning the subject
territory with a RC (Resource Conservation) zoning designation; and
WHEREAS, the Town of Los Gatos, as Lead Agency for environmental review for the
reorganization has determined annexation of the subject property is exempt from the California
Environmental Quality Act guidelines, pursuant to Section 15061(b)(3); and

WHEREAS, the County Surveyor of Santa Clara County has found the description and
map (Exhibits A and B) to be in accordance with Government Code Section 56757, the
boundaries to be definite and certain, and the proposal to be in compliance with LAFCO's road
annexation policies; and
WHEREAS, as provided in Government Code Section 56757, the Town Council of the
Town of Los Gatos shall be the conducting authority for a reorganization including an
annexation to the Town; and
WHEREAS, the territory is uninhabited and all owners of land included in the proposal
have consented to this annexation; and
WHEREAS, Government Code Section 56663(a) provides that if a petition for annexation
is signed by all owners of land within the affected territory the Town Council may approve or
disapprove the annexation without a public hearing.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Los Gatos
hereby initiates annexation proceedings and will consider annexation of the territory
designated as Shannon Road No. 27 at its regular meeting on January 16, 2018.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 19th day of December, 2017, by the following vote:

GEOGRAPHIC DESCRIPTION
All that real property situated in the unincorporated County of Santa Clara, State of California, being that
parcel as described in that certain Grant Deed recorded on February 10, 2003 as lnstruinent No. 1681 1628
of Official Records in the Office of the Recorder of the County of Santa Clara, State of California and that
certain parcel as described in that certain Grant Deed (Joint Tenancy) recorded on March 16. 1970 in
Book 9155 of Official Records Page 459 as Instrument No. 3922295 of Official Records in the Office of
said Recorder and portions of Shannon Road and Sky Lane, described as follows:
A portion of the Northwest One Quarter t I i4) of Section 24. Township 8 South. Range 1 West, Mount
Diablo Base and Meridian and being more particularly, described as follows:
BEGINNING at a point in the southwesterly right of way of Shannon Road (50' wide), also being a point
on the westerly line of said Section 24:
1) Thence, North 0'22'00" East 455.52 feet along the westerly line of said parcel in said
Instrument No. 1681 1628 of Official Records and said westerly line of said Section 24 to a
point in the southerly right of way of Sky Lane (40' wide); thence leaving said westerly
line and along said right away the following four (4) Courses:
2) North 84''49'00" West 142.19 feet,
3) North 26' 11'00" West 79.03 feet.
4) North 27'09'00" East 58.44 feet. and
5) North 83'30'00- East 151.76 feet to said westerly line of said Section 24; thence,
