FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
Emerald Lake Investments, a Nevada Limited Liability Company and Greenridge Terrace
Development, a California Limited Liability Company, hereby GRANTS to the TOWN OF
LOS GATOS, a California Municipal Corporation, a Public Service and Emergency
Vehicle Access Easement under, on, or over all the real property situated in the Town of
Los Gatos, County of Santa Clara, State of California, described as follows:
Legal Description as per Exhibit "A" and generally shown on Exhibit "B", attached
hereto and made a part herein.
The Public Service Easement is for public use for construction, maintenance and
access to any and all public service facilities including poles, wires, conduits, storm
sewers, and gas, water and heat mains and all public utilities and services along with all
appurtenances on, under, or over said easement. The Public Service Easement shall
be kept open and free from buildings and structures of any kind except public service
structures, irrigation systems, and appurtenances thereto, lawful fences, landscape
walls and entry monuments, retaining walls, and all lawful roof overhangs.
The Emergency Vehicle Access Easement is for ingress and egress of emergency
vehicles over and upon said easement.
