RESOLUTION OF THE TOWN OF LOS GATOS
ESTABLISHING A TOWN POLICY FOR HANDLING ABANDONED APPLICATIONS
RESOLVED, by the Town Council of the Town of Los Gatos, that the following
procedures be adopted as Town policy:
FURTHER RESOLVED, that Resolution No. 1984 -21 is hereby repealed.
1. Where there has been no activity on a development application for at least three
(3) months, the applicants shall be notified in writing that the matter has been considered
abandoned, and that the matter is being set for public hearing before the Planning
Commission on a date certain with a recommendation for denial.
2. If no response is received within 15 days of the date the letter is sent, the
application will be set for public hearing for denial. No mailed notice will be made unless
required by State law, and the legal advertisement and the agenda shall note the
recommended action and reason for such action.
3. If the applicants submitted a written confirmation that the application is
abandoned or is being withdrawn, the file will be closed and no further action is required.
4. If the applicants respond in writing that revised plans responding to deficiencies
will be submitted by a specific date, the application will be scheduled for the next
Development Review Committee after that date. If the revised plans are not submitted for
that meeting and a rescheduled meeting is not arranged, the application will be set for
public hearing before the Planning Commission with a recommendation for denial.
5. For projects deemed complete, the Planning Commission action shall be
completed within six (6) months after the project is deemed complete, unless the applicant
requests and the Planning Commission grants a further extension. For projects not yet
deemed complete, such action shall be completed within six (6) months of the last
Development Review Committee meeting on the matter.
6. A request to extend the processing time can be granted by the Planning Director
or Planning Commission as appropriate, but such extensions cannot extend any processing
time beyond the limits set by California Government Code Sections 65000 - 66009 as
appropriate.

7. There shall be no fee refunds or off -sets on future applications.
PASSED AND ADOPTED at a regular meeting of the Town Council held on
October 15, 1990 by the following vote:
COUNCIL MEMBERS:
AYES: Joanne Benjamin, Eric D. Carlson, Brent N. Ventura, and
Mayor Thomas J. Ferrito
NAYS: None.
ABSENT: Robert L. Hamilton
