RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
CONCERNING AN AMENDMENT TO THE HILLSIDE SPECIFIC PLAN
REGARDING THE DELETION OF THE DESIGNATION OF A PUBLIC
ACCESS ROAD THROUGH THE ST. JOSEPH'S HILL OPEN SPACE PRESERVE
WHEREAS, pursuant to the Government Code Section 65453, the Town Council
conducted a public hearing for consideration of an amendment to the Hillside Specific Plan
on July 2, 1990; and
WHEREAS, during the hearing, the Town Council considered Hillside Specific Plan
Amendment GP -90 -5 concerning the deletion of the designation of a public access road
to Foster Road through the St. Joseph's Hill Open Space Preserve.
RESOLVED, the Town Council finds that there is no possibility that the amendments
will have a significant impact on the environment; and therefore, the amendments are not
subject to the California Environmental Quality Act pursuant to Section 15061(b)(3) of the
CEQA Guidelines.
FURTHER RESOLVED, the Town Council finds that the Los Gatos Hillside Specific
Plan Amendment GP -90 -5 is (a) internally consistent with the Town of Los Gatos General
Plan, and (b) that all proceedings have been conducted in compliance with the provisions
of Government Code Section 65450 et seq.
FURTHER RESOLVED, the Town Council hereby amends the Circulation Element
of the Hillside Specific Plan as follows:
Policies Section 3.3.2 is recommended to be amended to read:
2. Private Roads Versus Public Roads:
a. An adequate system of publicly owned and maintained roads is the best
means of providing adequate access to all properties. Access by private
road shall not be allowed unless fundamental to a special approved design
concept, unless full provisions for construction and maintenance of the
private road system have been approved and unless it is consistent with
neighborhood circulation.
b. A private access road to Guadalupe College from the Lexington Reservoir
area will be provided from Alma Bridge Road /Limekiln Road. The
private access road shall incorporate provisions for emergency access to
Foster Road.
FURTHER RESOLVED, the Town Council hereby amends Hillside Specific Plan
Figures 1, 2, and 3 to delete the designation of a public access road through the St. Joseph's
Hill Open Space Preserve.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos this 2nd day of July, 1990, by the following vote:
