RESOLUTION OF THE TOWN OF LOS GATOS ORDERING VACATION OF A PORTION OF PUBLIC
RIGHT -OF -WAY LOCATED AT ROBERTS ROAD (WEST) ADJACENT TO
300 BLOSSOM HILL ROAD, FOR SUBDIVISION IMPROVEMENT PURPOSES.
WHEREAS, the Town Council of the Town of Los Gatos has proceeded under the
provisions of Division 9, Part 3, (Sections 8300 through 8331) of the Streets
and Highways Code concerning vacation of a portion of a public right -of -way
situated in the Town of Los Gatos, County of Santa Clara, State of California,
consisting of a strip of land approximately 146 feet long containing approximate-
ly 2,744 sq. ft. located along the easterly side of Roberts Road (West), south
of Blossom Hill Road, and more particularly described in Exhibit "A" (Description
of a portion of Roberts Road to be abandoned [Roberts Road West, adjacent to 300
Blossom Hill Road] by the Town of Los Gatos) , and Exhibit "B" (Plat to accompany
description for portion of Roberts Road to be vacated); and
WHEREAS, the public convenience and necessity may require the reservation
of public utility easements on and over and beneath all of that portion of
Roberts Road referred to in this resolution, for construction, maintenance,
operation, replacement, removal and renewal of sanitary sewers and storm drains
and appurtenant structures in, upon, over and across Roberts Road and pursuant
to any existing franchises or renewals thereof, or otherwise, for construction,
maintenance, operation, replacement, removal, renewal and enlargements of pipe
lines, conduit, cables, wires, hose and other convenient structures, equipment
and fixtures for the operation of gas pipe lines, telegraphic and telephone
lines, conduit, cables, wires, hose and other convenient structures, equipment
and fixtures for the transportation and distribution of electric energy,
petroleum and its products, water and incidental purposes, including access and
the right to keep the property free from inflammable materials, and wood growth,
and otherwise protect the same from all hazards, and the proceedings have been
taken subject to the reservations of such easements; and
WHEREAS, pursuant to the provisions of the Streets and Highways Code, a
Resolution of Intention was passed, a noticed hearing held, and good cause
appearing therefor.
RESOLVED, the Town Council of the Town of Los Gatos finds from all of the
evidence submitted that all of that portion of public right -of -way described
above is unnecessary for present or prospective roadway purposes, and hereby
makes its order vacating the public right -of -way dedication along Roberts Road
(West) adjacent to 300 Blossom Hill Road, reserving from such vacation all
easements described above which may be required.
BE IT ALSO RESOLVED that Town Council of the Town of Los Gatos, pursuant
to Streets and Highways Code Section 8356, orders conveyed to the subdivider said
land in exchange for dedications of open space lands shown on the tentative map.
Upon approval of the final subdivision map by the Town, the Town Manager is
hereby authorized to execute and, upon recording of the final map, the Town
Clerk is authorized to record a conveyance of said excess right -of -way to
subdivider.
FURTHER RESOLVE, the Town Clerk shall cause a certified copy of this Order
attested by her under the seal of the Town, to be recorded in the Office of the
County Recorder of the County of Santa Clara.
PASSED AND ADOPTED by the Town Council of the Town of Los Gatos at a
meeting held this 16th day of October 1989, by the following vote:

All that property situated in the Town of Los Gatos, County of Santa Clara, State
of California, being more particularly described as follows:
Commencing at the most Northwesterly corner of Parcel "D" as shown upon
that certain Record of Survey recorded in Book 151 of Maps at pages 36
and 37, Records of said Santa Clara County, said corner also being an
angle point in the centerline of Roberts Road as described in that
certain deed of right -of -way recorded October 8, 1892 in Book 149 of
Deeds page 452; thence South 110 47' 50" West along the centerline of
Roberts Road as described in said deed of right -of -way, a distance of
299.98 feet to the Southwesterly corner of Parcel "G ", as shown on said
Map; thence South 780 12' 10" East along the Southerly line of said
Parcel "G ", a distance of 33.70 feet to the TRUE POINT OF BEGINNING;
thence continuing along last named line South 780 12' 10" East, a
distance of 28.130 feet to the Southeasterly corner of said Parcel "G ";
thence North ll* 47' 50" East, along the Easterly line of said Parcel
"G ", a distance of 124.50 feet; thence leaving said Easterly line North
24" 40' 10" West, a distance of 26.92 feet to a point along a line
parallel with and distant thereon 44.00 feet Southeasterly, measured
at right angles, from said centerline of Roberts Road; thence South 11*
47' 50" West, along said parallel line, a distance of 34.60 feet;
thence Southerly along a tangent curve to the right, having a radius
of 274.00 feet, through a central angle of 9* 45' 05 ", an arc distance
of 46.63 feet to a point of reverse curvature; thence Southerly along
a tangent curve to the left having a radius of 350.00 feet, through a
central angle of 5° 43' 05 ", an arc distance of 34.93 feet; thence
tangent to the preceding curve South 150 49' 50" West a distance of
