A RESOLUTION OF THE TOWN OF LOS GATOS
ESTABLISHING CONFIDENTIAL EMPLOYEE CLASSIFICATIONS,
COMPENSATION AND WORK RULES
WHEREAS Resolution No. 1974 -41 establishes the procedure for recognition
of employee organizations and conferring with said organization,
WHEREAS, Resolution 1974 -41 Section 1(e) defines Employee, Confidential,
as an employee who is privy to decisions of Town management affecting employer -
employee relations,
NOW THEREFORE the Town Council of the Town of Los Gatos does hereby resolve
as follows:
1) Classifications designated as Confidential are shown in Exhibit A.
2) Classifications designated as confidential shall be compensated at
the rate established in the annual position and classification system
and as shown in Exhibit A. Compensation level includes a 5% premium
in recognition of the assignment of the classification to the
Confidential unit.
3) Employee benefits and work rules are included in Exhibit B.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 17th day of July, 1989 by the following vote:

Confidential Unit
Compensation and Work Rule Plan
Compensation Salary ranges for Confidential employees shall be included in the annual
Position and Classification Plan. Compensation includes a 5% premium in
recognition of assignment to the confidential unit.
Benefits /Work
Rules
Confidential Employees shall be subject to policies and procedures set
forth in the Town Personnel Rules and Administrative Manual.
Confidential Employee shall be entitled to the benefits and work rules
provided for in the following sections of the Memorandum of Understanding
with the Town Employees Association (TEA):

5.d. Callback
5.j. Incentive pay program
5.k. Holiday compensation
5.1. New pay and classification

7 Benefits
8 Vacations and leaves

Representation Confidential employees are not represented by an employee organization.
Individuals with Labor relations concerns shall address these concerns
with their supervisors.
