RESOLUTION OF THE TOWN OF LOS GATOS DENYING
APPEAL OF PLANNING COMMISSION DENIAL OF REQUEST
FOR ZONING ORDINANCE AMENDMENT TO CONSIDER
ALLOWING A CARETAKER'S RESIDENCE IN THE R -1 ZONE
WITH A CONDITIONAL USE PERMIT
(1690 FARLEY ROAD - EVELYN HART WATSON)
WHEREAS:
1. Edison W. Miller, counsel on behalf of Evelyn Hart Watson, has appealed a
decision of the Planning Commission as follows: denial of request for Zoning Ordinance
Amendment A- 88 -14, a consideration to allows a caretaker's residence in the R -1 zone with
a conditional use permit, said request being made by Evelyn Hart Watson, property owner
at 16920 Farley Road; and
2. A public hearing was held by the Town Council on March 6, 1989 and on May
1, 1989.
BE IT RESOLVED:
1. The Town Council hereby finds that no evidence or testimony was presented
that the Planning Commission decision was in error.
2. The Town Council further finds that the proposed ordinance change would
cause a regulatory problem and confusion concerning secondary dwelling units and that the
proposed ordinance is contrary to the Town's policies on density.
3. The Town Council hereby further finds that the thirty (30) square foot
limitation on additions to secondary dwelling units should be maintained.
4. Based on the foregoing findings, the decision of the Planning Commission is
affirmed and the appeal is hereby denied.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 15th day of May, 1989 by the following vote:
