1989-017-Authorizing Agreement To Prepare A Comprehensive Assessment Of Impacts Of Alternative Access Roads To The Western California University SiteRESOLUTION NO. 1989 -17 RESOLUTION AUTHORIZING AGREEMENT TO PREPARE A COMPREHENSIVE ASSESSMENT OF IMPACTS OF ALTERNATIVE ACCESS ROADS TO THE WESTERN CALIFORNIA UNIVERSITY SITE RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the TOWN OF LOS GATOS enter into an Agreement to prepare a comprehensive Alternative Access Road Study with Kreines & Kreines, as per Exhibit A attached hereto, and that the Town Manager is authorized, and is hereby directed, to execute said Agreement in the name and in behalf of the TOWN OF LOS GATOS. CONSULTANT). The TOWN desires to contract for the assessment of impacts of alternative access roads to the Western California University site at the southerly termi- nus of Foster Road. The CONSULTANT is willing to perform such professional servicers upon the terms and conditions herein set forth: THE PARTIES DO HEREBY AGREE AS FOLLOWS: 1. SERVICES CONSULTANT shall perform those professional services described in the "Phase I - Scope of Services" attached as "ATTACHMENT I" and in Phase II "Matrix Approach" attached as "ATTACHMENT III. ". 2. PAYMENT FOR SERVICES The cost of those services described in "Attachment I" shall not exceed $8,200.00, and for these services described in "ATTACHMENT III" shall not exceed $20,000.00. Payment shall be authorized upon receipt of a billing describing work performed and cost of services. 3• WORK SCHEDULE The time schedule for delivery of all environmental documents as described in ATTACHMENT II and III shall commence from the date written authorization is received from the TOWN to begin work. It is the responsibility of the consultant to advise the TOWN that they have received all documents agreed upon from the TOWN, or other such sources as has been determined previously by the TOWN. 4. NON- PERFORMANCE The CONSULTANT is not responsible for delay in delivering environmental documents due to fires, strikes, labor disputes or other substantial cause that the CONSULTANT cannot control. The existence of such cause justifies extension of time for performance to the extent that is reasonably neces- sary, but the CONSULTANT must exercise diligence to complete its work. If performance by the CONSULTANT is impossible or unreasonably difficult because of failure by the Town to provide information or refusal to permit access to land, the CONSULTANT need not perform, but must promptly notify the Planning Director in writing of the difficulty. Payment will be authorized for work completed to the satisfaction of the Planning Director. 5. MISCELLANEOUS CONTRACT PROVISIONS The CONSULTANT will keep confidential any information supplied to him /her by the TOWN which is designated confidential, regardless of whether the in- formation might be made public by someone other than the CONSULTANT. All material and all compilations of information produced by the CONSULTANT specifically to perform this contract are and remain the property of the TOWN regardless of whether it is required to be, or is, actually delivered to the TOWN. The CONSULTANT may perform some of his /her obligations under this contract by subcontracting, but may not delegate his /her ultimate responsibility for performance nor assign his /her rights under this contract. 6. NOTICES Any notice required to be given to CONSULTANT shall be deemed to be duly and properly given if mailed to CONSULTANT postage prepaid, and addressed to: KREINES & KREINES INC. 58 Paseo Mirasol Tiburon, CA 94920 or personally delivered to CONSULTANT at such address or such other address as CONSULTANT designates in writing to TOWN. By: PRESIDENT - 3 - ATTACHMENT I PHASE I - SCOPE OF SERVICES 1. NEGOTIATION OF CONTRACT (some of this work is already done): 1.1 Consult with Town staff, including Town Attorney and Town Manager, prior to Town Council meeting of 12/19/88. 1.2 Draft Phase I contract subsequent to and based upon comments of 12/19/88 meeting. 1.3 Attend any other informal or formal meetings regarding scope of services prior to execution of contract. 2. AGREE ON PROJECT AREAS AND LIMEKILN ROAD ALIGNMENT. Obtain agreement with Town staff including Planning Director and Traffic Engineer on two known alignments and project areas for other alignments. 2.1 Consultant and subconsultants will field check the general alignments for both Alma Bridge Road and Limekiln Road, e.g.: 2.1.1 Walk the Creegan & D'Angelo alignment, as shown in Exhibit B. 2.1.2 Walk the straight (no switchbacks) Limekiln Road alignment. 2.1.3 Walk a hybrid alignment combining Alma Bridge and Limekiln Roads. 2.2 Describe any new general alignments on 1" =500' sketches. 2.2.1 Have sketch ready for 1/9/89 Study Session. 2.2.2 Sketch(es) should be reproducible by photocopying. 2.3 Walk most feasible general alignment with staff if necessary. 2.4 Project areas would be only those corridors within which an alignment falls. 2.4.1 Assume 200 feet on either side of alignments. 2.4.2 Includes portion of existing Alma Bridge Road and Limekiln Road traversed by Limekiln Road alignment drivers. 3. FIELD TRIP AND NOTIFICATION 3.1 Conduct field trip of Alma Bridge Road and Limekiln Road alignment on 1/7/89 or 1/8/89 when interested members of the public are invited to attend. 3.1.1 Kreines & Kreines, Inc. would begin the field trip in the early morning from the S.R. 17 /Alma Bridge Road intersection. The Alma Bridge Road alignment will be taken to the top of the ridge. A bring -your- own lunch stop would occur at Western California University. Return would be via the Limekiln Road alignment. 3.1.2 All noticing and arrangements would be made by the Town of Los Gatos. 3.2 Notify adjacent property owners, e.g.: 3.2.1 Snell 3.2.2 Carroll 3.2.3 Santa Clara Valley Water District 3.2.4 Note specifically that above list may not be exhaustive. 4. STUDY SESSION 4.1 Consult with Town Council on evening of 1/9/89. 4.1.1 All subconsultants to be present. 4.1.2 Base maps available. 4.2 Respond to questions regarding ... 4.2.1 Known alignments: 4.2.1.1 Potential problems. 4.2.1.2 Advantages over others. 4.2.2 Possible new alignments. 2 4.3 Sketch any potential other alignments at Study Session. 4.3.1 Line on map only. 4.3.2 Leave as many new alignments with Town council as requested. 4.3.3 Sketch potential road profiles. 4.3.3.1 Roadway "prism ". 4.3.3.2 Possible retaining walls and fill. 4.4 Decisions to be reached. 4.4.1 Town Council to decide when ... 4.4.1.1 Any new alignments will be selected. 4.4.1.2 Consultants should continue work. 4.4.2 Consultants to inform Town Council: 4.4.2.1 How long next step(s) might take. 4.4.2.2 Additional cost requirements. 3 PHASE I COSTS Costs to prepare this Phase I work of the impacts of alternative access roads to Western California University are $8,200.00. Factors that would increase the scope of work and estimated cost outlined in this proposal include: attendance at additional meetings and analysis of any issues other than those identified in this proposal. We would either renegotiate these items or charge on a time - and - materials basis. This cost estimate assumes that the following items are made available without charge to the consultant: Previous Creegan & D'Angelo drawings. Existing soils and geologic reports not identified in this proposal. Town of Los Gatos road standards. We will submit an invoice to the Town of Los Gatos for work performed during January 1989. R ATTACHMENT III MATRIX APPROACH We are proposing a matrix approach which will not result in a voluminous report or a substantial amount of study. Further design would be necessary and the following ormat would b followed: Subject Jumping -off- Point for New Con- struction Cut Slope (horizontal to vertical) Gradient Width Length Blue Route We will dis- cuss the need to start at a higher eleva- tion. We will mea- sure this at approximately each 300 feet on a ratio ba- sis (e.g., 2:1). We will mea- sure this on a percentage ba- sis within 300 -foot sections. We will indi- cate where road must stay within 18' minimum and where it can go to 24' min- imum. We will mea- sure the road from beginning of improve- ments to the end of im- provements. 1 g u e Green Route We will dis- cuss reasons for the need to start as low as pos- sible. We will mea- sure this at approximately each 300 feet on a ratio basis (e.g., 2:1). We will mea- sure this on a percentage basis within 300 -foot sections. We will indi- cate where road must stay within 18' minimum and where it can go to 24' min- imum. We will mea- sure the road from beginning of improve- ments to the end of im- provements. ON Green Route We will char- acterize the ownership of land this road traverses and the number of fire roads, driveways and trail cross- ings encoun- tered. We will iden- tify where opportunities for develop- ment are cre- ated by this road (e.g., lots on Snell and /or Car- roll). We will give qualitative estimates of cost (more than the other alternative or less than the other alter- native) rather than actual values. We will indi- cate and mea- sure those lo- cations where sight distance may be a prob- lem. Alma Bridge Alternative We will charac- terize the own- ership of land this road tra- verses and the number of fire roads, drive- ways and trail crossings en- countered. We will assume that no further development op- portunities are created by this road. We will use Creegan & D'Angelo's cost estimates up- dated per the Construction Cost Index. We will indi- cate and mea- sure those lo- cations where sight distance may be a prob- lem. Subject Visibility Safety Land Acqui- sition Blue Route We will indi- cate and mea- sure those segments which have "populated viewing ar- eas," "unpopulated viewing areas" or "minimal viewing ar- eas." We will iden- tify those segments of the road that create prob- lems of stop- ping distance, vertical alignment and horizontal alignment (including width and turning radii). We will iden- tify any lands which must be purchased or over which an easement will be required, except for possible drainage ease- ments. 3 Green Route We will indi- cate and mea- sure those segments which have "populated viewing ar- eas," "unpopulated viewing areas" or "minimal viewing ar- eas." We will iden- tify those segments of the road that create prob- lems of stop- ping distance, vertical alignment and horizontal alignment (including width and turning radii). We will iden- tify any lands which must be purchased or over which an easement will be required, except for possible drainage ease- ments. Alma Bridge Alternative We will indi- cate and mea- sure those seg- ments which have "populated viewing areas," "unpopulated viewing areas" or "minimal viewing areas." We will iden- tify those seg- ments of the road that cre- ate problems of stopping dis- tance, vertical alignment and horizontal alignment (including width and turn- ing radii). We will iden- tify any lands which must be purchased or over which an easement will be required, except for pos- sible drainage easements. Subject Tree Removal Geology Blue Route We will count all trees over 12 inches in circumference in the field which we be- lieve will be removed or de- stroyed by the road or neces- sary grading. We will iden- tify areas of proposed cuts, proposed fills, neces- sary struc- tural improve- ments, and we will identify materials encountered by geologic formations. Estimates of cut, fill and net off -haul volumes will be made by de- termining in- terim sections and the infer- ence of vol- umes between sections. 0 Green Route We will count all trees over 12 inches in circumference in the field which we be- lieve will be removed or de- stroyed by the road or neces- sary grading. Alma Bridge Alternative We will rely entirely on the Creegan & D'Angelo report of 5/23/88. We will rely entirely on ma- terials pro- vided to us by Creegan & D'Angelo. This material may or may not use the same method em- ployed for the Blue Route and the Green Route. Subject Precedent Setting Ten- dency COSTS Blue Route We will assume the worst im- pacts from the above analysis and identify the extent to which they may be replicated elsewhere in Los Gatos. For example, the use of ad- joining pri- vate property to realize, for public purposes a road for ac- cess could in- duce other such projects in the Town of Los Gatos. Green Route We will assume the worst im- pacts from the above analysis and identify the extent to which they may be replicated elsewhere in Los Gatos. For example, the destruc- tion of a ri- parian site for a road could be successfully applied else- where in Los Gatos. Alma Bridge Alternative We will assume the worst im- pacts from the above analysis and identify the extent to which they may be replicated elsewhere in Los Gatos. For example, the use of ex- isting open space land for a road align- ment could oc- cur elsewhere in Los Gatos. The cost for the above analysis will be $20,000, which is less than that first quoted to the Town of Los Gatos. A higher estimate of $23,750 would have included quantitative cost estimates and actual pavement delineation. The above material could be provided on only one route (Blue Route or Green Route) at a reduced cost of $16,000. The selection of which route to be analyzed by matrix must be made by the Town of Los Gatos and be made part of the contract. This cost includes attendance by Kreines & Kreines at one presentation meeting without subcontractors. We are assuming that all Creegan & D'Angelo material will be provided to us without charge. M Factors that would increase the costs outlined in this memorandum include: attendance at additional meetings by Kreines & Kreines and /or subcontractors' attendance at meetings; analysis of any issues other than those identified in this proposal and changes in the project requiring re- analysis or rewriting of matrix sections. PRODUCTS One 1" = 100' reproducible for the Blue Route alignment and one for the Green Route alignment will be provided with one copy of the matrix analysis. SCHEDULE We are prepared to begin immediately and will deliver the above described matrix analysis and supporting graphic material within 45 days of the receipt of a fully executed contract from the Town of Los Gatos. 2
