RESOLUTION NO: 1988 -140
RESOLUTION GRANTING APPEAL OF PLANNING COMMISSION
DENIAL OF REQUEST FOR APPROVAL OF A TWO -LOT
SUBDIVISION OF PROPERTY IN THE R- 1:30,000 ZONE
(16270 KENNEDY ROAD - DAVID B. AND DIANE GOLDBERG)
WHEREAS:
A. David B. and Diane Goldberg have appealed a decision of the
Planning Commission as follows: denial of Subdivision Application M- 80 -18A
requesting approval of a two -lot subdivision of property in the R- 1:30,000
Zone located at 16270 Kennedy Road and owned by David B. and Diane
Goldberg; and
B. A public hearing was held by the Town Council on June 6, 1988
and June 20, 1988.
BE IT RESOLVED:
A. The Town Council hereby finds as follows:
1. The applicants have withdrawn their application for
secondary dwelling unit permits; and
2. The tentative map has been withdrawn so that neither of
the lots is over 60,000 square feet.
B. Based on the findings set forth in paragrah A, the Town
Council hereby further finds that the application is consistent with the
Town's traffic policy for subdivisions.
C. The Town Council hereby further finds that the subdivision
application is consistent with the General Plan and the Hillside Specific
Plan and that reasons for denial do not exist pursuant to Government Code
Section 66474.
D. Based on the foregoing findings indicating a change in
circumstances, the Town Council hereby grants the appeal and approves
Subdivision Application M- 80 -18A with the following conditions:
TO THE SATISFACTION OF THE TOWN ENGINEER:
1. The public roadway shall be spot widened along the Kennedy
Road frontage and roadside drainage facilities installed.
2. A parcel map shall be filed.
3. The following shall be dedicated:
a. Kennedy Road. A 30 -foot half - street right of way.
b. Ingress- egress, storm drain, sanitary sewer and public
easements as required.
4. Cable television facilities shall be provided to each lot.
5. All lots shall be surveyed and monumented (set pipes) prior to
construction.
6. A well information questionnaire shall be completed.
�. All documents, contracts, bonds, insurance, as applicable,
shall be provided prior to recordation of any final map or
issuance of any permits.
TO THE SATISFACTION OF THE PLANNING DIRECTOR AND BUILDING OFFICIAL:
8. The two secondary dwelling units shall be demolished or all
kitchen and plumbing facilities removed from them so that they
may not be used as a dwelling of any type.

Town of Los Gatos, California, held on the 5th day of July
1988 by the following vote.
