RESOLUTION REMANDING TO PLANNING COMMISSION THE APPEAL
OF PLANNING COMMISSION DENIAL OF REQUEST TO ENCLOSE AN
EXISTING DETACHED REFRIGERATION UNIT FOR A COMMERCIAL
BUILDING IN THE C -2 ZONE
(208 BACHMAN AVENUE - C.B. HANNEGAN'S)
WHEREAS:
1. Randall D. Reedy, counsel for applicant Chris Benson, has
appealed a decision of the Planning Commission as follows: Denial of
request to enclose an existing detached refrigeration unit for a
commercial building in the C -2 Zone on property located at 208 Bachman
Avenue and owned by Bert Millen - business co- owners Chris Benson and John
Hannegan (Architecture and Site Application S- 80 -34C and Conditional Use
Permit U- 81 -3B); and
2. A public hearing was set for December 7, 1987 and continued to
and held on January 19, 1988.
BE IT RESOLVED:
1. The Town Council hereby finds that the appellant desires to
submit a new plan to include moving the refrigerator and correcting the
corner of the building.
2. Based on the foregoing, the Town Council hereby remands the
appeal to the Planning Commission for consideration of a new plan to be
submitted by the applicant.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 1 day of February
1988 by the following vote.
