1988-003-Concerning Amendments To The Downtown Specific Plan Regrading Traffic ImpactsRESOLUTION NO. 1988 -3 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS CONCERNING AMENDMENTS TO THE DOWNTOWN SPECIFIC PLAN REGARDING TRAFFIC IMPACTS WHEREAS, pursuant to provisions of Government Code Section 65453, the Town Council of the Town of Los Gatos conducted a public hearing for consideration of amendments to the Downtown Specific Plan on October 19, November 2, December %, December 21, 198 7, and January 4, 1988. WHEREAS, during these hearings the Town Council considered Downtown Specif- ic Plan Amendment GP -87-9 relating to the traffic impacts as recommended by the Planning Commission. RESOLVED: The Town Council finds that the amendments will not have a significant impact on the environment and makes the Negative Declaration. FURTHER RESOLVED: The Town Council find that Los Gatos Downtown Specific Plan Amendment GP -87-9 (a) meets the requirements for a specific plan, (b) is consistent with the Town of Los Gatos General Plan, and (c) that all proceedings have been conducted in compliance with the provisions for Govern- ment Code Section 65453 et seq. FURTHER RESOLVED: Circulation and Transportation Section V.C.1. of the Downtown Specific Plan is amended to read as follows: IMPLEMENTATION C. Traffic /Roadway Capacity Review 1. Required Review: Any project or development within the Town of Los Gatos that will add traffic to Downtown roadways and /or intersections will be sub- ject to review and approval by the Town. Each request for review shall be analyzed and a determination made on: 1) the ability of roadways and intersections to accommodate existing traffic; 2) increased traffic estimated for approved developments not yet occupied; and 3) regional traffic growth and traffic anticipated for the proposed project one year after occupancy. All developers shall be required to show if their projects have any impacts on the Downtown roadways and /or intersections as follows: The deciding body shall review the project's impact on traffic roadway /intersection capacity and make one of the following determinations: a. The project will not impact any roadways and /or intersections causing the roadways and /or intersections to exceed their available capacities. b. The project will impact a roadway(s) and /or intersection(s) causing the roadway(s) and /or intersection(s) to exceed their available capacities. Any project receiving Town determination a. may proceed. Any proj- ect receiving Town determination b. shall not be approved. 2. Exceptions: The following are exceptions for projects that add traffic to a critical intersection(s) for which no capacity improvements are planned: a. Vacant Parcels (1) An existing vacant parcel designated for residential use may be developed with a single family dwelling. (2) Any residential project (i.e., subdivision, multiple family residential development, Planned Development, etc.) may be approved on a vacant parcel, subject to all other Town Policies and Regulations, providing the deciding body makes the findings as specified by Town Council Resolution. (3) An existing vacant parcel designated for nonresidential use may be developed, providing the project does not generate traffic in excess of that which would be generated by a re- tail use within a building with a floor area ratio of 0.6. A vacant parcel is any property that is not improved with any structures. b. Improved Parcels (1) For parcels on which a structure(s) is destroyed or razed after May 18, 1982: (a) A new structure may be reconstructed with the identical use and number of trips generated, or; (b) A new structure with a different use may be construct- ed, subject to all other zoning restrictions, as long as the traffic generated by the use does not exceed that which was generated by the previous use, or; - 2 - (c) If the razed or destroyed structure has been vacant for so long that the traffic generated by the previous use cannot be determined or the structure had been designed for a use no longer permitted in the zone, a new structure may be built which does not generate traffic in excess of that which would be generated by a retail use within a building with a floor area ratio of 0.6. (2) Parcels designated for residential use which are improved with an existing single family dwelling may be divided into a maximum of two lots as long as the division complies with all adopted policies regulating lot splits and would permit the construction of only one additional single family dwelling.
