RESOLUTION GRANTING APPEAL OF PLANNING COMMISSION APPROVAL
WITH CONDITIONS FOR EXTERIOR MODIFICATION OF AN EXISTING
OFFICE BUILDING AND ABANDONMENT OF EXCESS RIGHT -OF -WAY
ACROSS THE FRONTAGE OF THE PROPERTY IN THE "0" ZONE.

WHEREAS:
A. Steven G. Baird, counsel for John L. Scott, has appealed a
decision of the Planning Cor:mission as follows: Approval with conditions
of Architecture and Site Application S -80 -105 -C for exterior modification
of an existing office building and abandonment of excess right -of -way
across the frontage of the property in the "0" Zone on property located at
234 Los Gatos Boulevard and owned by John L. Scott; and
1987.
B. A public hearing was held by the Town Council on October 19,
IT IS HEREBY RESOLVED:
A. The Town Council hereby finds that the Planning Commission did
not err in considering neighborhood objection to an awning on the
property.
B. Based on the foregoing finding, the appeal is hereby denied
and Architecture and Site Application is hereby granted subject to the
following conditions:
1. The applicant shall remove the encroaching pipe and overlying
concrete located in the gutter of Los Gatos Blvd. If the
applicant should damage the underlying concrete during the
removal of the pipe and overlying concrete, the applicant will
repair such damage. If the applicant should damage the
underlying curb and gutter to such an extent that they are
rude unservicable, the applicant shall replace the underlying
curb and gutter as per the existing Town standard for
replacement curbs and gutters to the satisfaction of the Town
Engineer, His determinations as to requirements shall be
final.
2. Any work in the public right -of -way will require an
Encroachment Permit, to the satisfaction of the Town Engineer.
3. The framework for the present illegal awning be removed and
not replaced nor any other structure of any sort be placed
there without permission of the Town Planning Commission.
Framework to be removed within two weeks.
4. A redwood planter box with annuals shall be placed next to the
driveway, and a vine will be placed on the front of the
trellis, to the satisfaction of the Planning Director, to
prohibit vehicles from parking.
5. A five -year tree maintenance contract shall be established for
the protection of existing and newly planted trees, to the
satisfaction of the Town Engineer.

6. No portion of the addition may be closer than 6 ft. 8 in. to
the south side property line.
7. No more than one doctor or chiropractor for each available set
of five parking spaces shall be on duty at any time.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 109+.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 2 day of November
1987 by the following vote.
