1987-055-Urging Prompt And Proper Compliance With The Safe Drinking Water And Toxic Enforcement Act Of 1986RESOLUTION N0, 1987 -55 URGING PROMPT AND PROPER COMPLIANCE WITH THE SAFE DRINKING WATER AND TOXIC ENFORCEMENT ACT OF 1986 WHEREAS, Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986, was approved by an overwhelming majority of the voters of the State of California at an election held in November 1986; and WHEREAS, Proposition 65 was intended to reduce the serious threat that hazardous chemicals pose to the health and well being of the people of the State of California; and WHEREAS, by enacting Proposition 65, the people have declared their right to protect themselves and the water they drink against chemicals that cause, cancer, birth defects, and reproductive harm; and WHEREAS, the people have a right and a need to be informed about exposures to chemicals that cause cancer, birth defects, and reproductive harm; and WHEREAS, the people of the State of California demand and should be provided with prompt and proper enforcement of the laws controlling hazardous chemicals, in order to protect the public health, safety and welfare, and WHEREAS, Proposition 65 mandates that by Plarch 1, 1987, the Governor of the State of California shall publish a list of toxic chemicals that includes, at a minimum, those materials referenced in Labor Code Section 6382 (b) (1), and those substances identified additionally by reference in labor Code Section 6382 (d), totalling more than 200 substances; and WHEREAS, the Governor's advisors have urged him to publish the full list called for in the above noted Sections of the Labor Code; and 4JHEREAS, the Governor has nonetheless failed and refused to publish the minimum list mandated under Proposition 65; and WHEREAS, the Governor's failure and refusal to follow the dictates of the law is a potential danger to the public health, safety, and welfare, DOW THEREFORE BE IT RESOLVED that the Town Council of the Town of Los Gatos herebv urges the Governor of the State of California promptly and properly to publish a - list Of substances known to cause cancer or reproductive toxicity, as required bv Section 26249^8 of the Health and Safety Code, as enacted by Proposition 65, ` BE IT FURTHER RESOLVED that the Town Council of the Town of Los Gatos herebv urges the League Of California Cities, of which it is a member, to take any and all actions necessary to secure prONpt and proper compliance, by the Governor, with the requirements Of Proposition 66, and specifically with respect to the publication Of the list Called for by section 6249^8 of the Health and Safety Code, including efforts of persuasion directed towards the Governor, and also participation in initiation of any appropriate legal action.
